I.              Rule 10A.  for the conduct of the meetings of the South Kingstown Town Council:  Members of the public shall be entitled to speak at regular meetings during any period designated on the agenda for public comment, once, for a period of five minutes, or longer at the discretion of the President, and at other times when invited to do so by the President.  The public shall address their comments to the question under debate as indicated on the agenda. Pursuant to RI General Laws §42-46-6(b), public comment regarding subject matter not on the agenda but received during the public participation portion of a meeting shall be for information purposes only and may not be voted on except where necessary to address an unexpected occurrence that requires immediate action to protect the public or to refer the matter to an appropriate committee or to another body or official.

 

II.             Rule 11:  No item of business other than that of adjournment may be brought before the Town Council at any meeting unless such an item is introduced before 11:00 PM; provided, however, that this rule may be suspended by an affirmative vote of a majority of members present.

 

III.            Rule 13:  All items listed with a (CA) are to be considered routine by the Town Council and will be enacted by one motion.  There will be no separate discussion of these items unless a member of the Council, or a member of the public so requests, in which event the item will be removed from Consent Agenda (CA) consideration and considered in its normal sequence on the agenda.

 

Pursuant to RIGL §42-46-6(b). Section 21-2. Applicability.

 

Repeal in its entirety and replace with the following:

 

The special flood hazard areas are herein established as a floodplain overlay district.  The district includes all special flood hazard areas within the Town of South Kingstown designated as zone A, AE, AH, AO, A99, V, or VE on the Washington County Flood Insurance Rate Map (FIRM) and Digital FIRM issued by the Federal Emergency Management Agency (FEMA) for the administration of the National Flood Insurance Program.  The map panels of Washington County FIRM that are wholly or partially within the Town are panel numbers 44009C0090J, 44009C0093J, 44009C0094J, 44009C0114K, 44009C0178J, 44009C0179J, 44009C0180J, 44009C0184K, 44009C0185J, 44009C0186J, 44009C0187J, 44009C0191J, 44009C0201J, 44009C0202K, 44009C0203K, 44009C0204K, dated April 3, 2020; and 44009C0188J, 44009C0189J, 44009C0192J, 44009C0193J, 44009C0194J, 44009C0211J, 44009C0282J, 44009C0301J, 44009C0302J and 44009C0306J dated October 16, 2013.  The exact boundaries of the District may be defined by the 100-year base flood elevations shown on the FIRM and further defined by the Washington County Flood Insurance Study (FIS) report dated April 3, 2020.  The office of the building official is responsible for floodplain management.  The FIRM and FIS report and any revisions thereto are incorporated herein by reference and are on file with the Town Building Official.

CHAPTER 12

OFFENSES AND MISCELLANEOUS PROVISIONS

Article II. Unruly Gatherings

 

*   *   *

Sec. 12-14. Definitions.

 

For purposes of this Article, the following terms shall have the meanings ascribed to them by this section:

           

Landlord Effective Period means a period beginning on the date of notice of violation and ending three years from that date.

 

Persons Liable means all of the following:

(A)       Any person who owns or manages property on which a Public Nuisance occurs.

(B)       Any person who organizes, hosts, sponsors, permits, or suffers the occurrence of an event constituting a Public Nuisance.

 

Public Nuisance means a gathering of five or more persons on any private property where conducts occurs that causes a substantial disturbance of the quiet enjoyment of private or public property in a significant segment of a neighborhood as a result of conduct constitution a violation of law. Illustrative of such unlawful conduct is excessive noise or traffic, obstruction of public streets by crowds of vehicles, illegal parking, public drunkenness, public urination, the service of alcohol to minors, fights, disturbance of the peace, and litter.

 

Tenant Effective Period means a period

            (A)       beginning June 1st and ending August 31st of a given year; or

(B)       beginning September 1st of a given year and ending May 31st of the next year.

 

Sec. 12-15. Prohibitions.

 

(a)       No person shall conduct, organize, sponsor, host, permit, or suffer to occur an event constituting a Public Nuisance.

 

(b)       The South Kingstown Police may abate a Public Nuisance by all reasonable means, including issuing an order requiring the gathering to be disbanded, issuing a citation to any violators, and arresting any violators under any applicable ordinance or state statute.

 

(c)        Nothing in this Article shall be construed to hold liable any resident of property who was (i) unaware of the Public Nuisance and (ii) was not in attendance on the premises during the Public Nuisance.

 

(d)       Nothing in this Article shall be construed to hold liable an owner, resident, sponsor, or organizer for the conduct of persons who are present without the express or implied consent of the owner, resident, sponsor, or organizer, provided that the owner, resident, sponsor, or organizer has taken all steps reasonably necessary to exclude such persons from the premises.

 

Sec. 12-16. Sanctions.

 

(a)       For the first occurrence of a Public Nuisance, the Persons Liable shall be provided notice in the manner set forth below.

 

(b)       The owner or manager of the premises shall be fined in the amount of five hundred dollars ($500.00) for any subsequent Public Nuisance on the same premises within a Landlord Effective Period.

 

(c)        Any person who violates section 12-15(a) but is not an owner or manager of the offending premises shall be fined in the amount of five hundred dollars ($500.00) for any subsequent Public Nuisance on the same premises within a Tenant Effective Period.

 

Sec. 12-17. Notice.

 

(a)       The South Kingstown Police Department shall furnish the premises with a notice when it intervenes at a Public Nuisance. The notice shall contain a statement which sufficiently informs the reader of the following information: (i) that the intervention of the police was necessitated as a result of a public nuisance under this article, (ii) the date of the police intervention, and (iii) that any subsequent Public Nuisance within a Landlord Effective Period or a Tenant Effective Period shall result in the liability of any violator for the amount set forth in section 12-16(b).

 

(b)       The South Kingstown Police Department shall send via regular and certified mail notice to (i) the owner or owners of the property upon which a Public Nuisance occurs, and (ii) the resident or residents of the property upon which a Public Nuisance occurs. The contents of the statement shall be substantially similar to the notice required in subsection (a).

Sec. 12-18. Right to Contest Penalty.

 

(a)       Any person fined under section 12-16 or provided notice under section 12-17 may contest the issuance of the fine or notice by filing a written petition for review with the Town Manager requesting that the Town Manager determine whether justification existed for issuing the fine or notice. The petition shall not be filed (i) later than ten days after the issuance of the notice or, (ii) if the notice is given by mail, later than fifteen days after the date of the mailing of the notice.

 

(b)       The Town Manager shall set a time and date for a hearing which shall be held no later than thirty days after receipt of the written petition and shall notify the petitioner and the solicitor’s office of the hearing date.

 

This ordinance shall take effect upon passage.

CHAPTER 16

STREETS AND SIDEWALKS

Article II. Town Rights-Of-Way

Sec. 16-27. Permit.

 

      (a) No licensed person, governmental agency or public service company shall perform any work on any town highway, road, street, etc., in the town without first obtaining a permit to do so from the director of public works. As a condition of the permit, said licensed person, governmental agency or public service company shall be required to completely repave and repair the roadway from curbline to curbline. for any area of the roadway that is altered, excavated, disrupted or disturbed. The scope of the road repair shall be determined by the director of public works and shall include, but not be limited to, asphalt removal and disposal and/or reclaiming the roadway subbase from curb-to-curb and placement of new bituminous concrete base and finish course asphalt.

Sec. 16-41.  Utility main extensions.

 

      (a) Permit applications for all utility main extensions; water, gas, sewer, underground telephone and electric cable; shall be filed with the public services office thirty (30) days in advance of anticipated date of construction. These permits will be reviewed by all appropriate department heads before a permit is issued. The applicant shall include a plan and profile of the proposed utility main extension in a format acceptable to the public services director. As a condition of said permit, the applicant shall be required to:

                      i.        Install service laterals for each respective utility to the property line for any parcel abutting the proposed utility main extension, provided, however, the director of public works may waive this requirement for gas service laterals if, in his opinion, it is unlikely that said gas service lateral will be put to use within five years from its installation. c

                    ii.        Completely repave and repair the roadway from curbline to curbline. for any area of the roadway that is altered, excavated, disrupted or disturbed as a result of the extension.The scope of the road repair shall be determined by the director of public works and shall include, but not be limited to, asphalt removal and disposal and/or reclaiming the roadway subbase from curb-to-curb and placement of new bituminous concrete base and finish course asphalt.

 

      (b) Location of the main extension within the town right-of-way will be determined by the director of public works. Temporary and permanent trench restorations shall be stipulated by the director of public works on a case by case basis and in accordance with the existing road surface and subbase. This shall include repaving and repairing the roadway from curbline to curbline. for any area of the roadway that is altered, excavated, disrupted or disturbed.

DALE S. HOLBERTON

 

WHEREAS,  DALE S. HOLBERTON, the 16th Town Clerk in the history of the Town of South Kingstown, is retiring after more than 39 years of dedicated service, having begun her municipal career with the Town Clerk’s office in September 1980. From the start, her strong work ethic, competency, compassion and leadership were clearly evident, and in this regard, Ms. Holberton was promoted to Deputy Town Clerk in 1985 and appointed as Town Clerk on February 2, 1987.  She held this position for the last 33 years, tying the record for the 3rd longest serving Town Clerk in South Kingstown with James Helme, surpassed only by Foster Sheldon who served 36 years, and Howard B. Perry, 55 years; and

 

WHEREAS,  throughout her tenure, Dale has served as Town Clerk to 17 different Town Councils, Probate Clerk under 6 probate judges, administered 51 elections as Clerk to the Canvassing Authority, orchestrated 19 Financial Town Meetings and one all day Budget Referendum; and

 

WHEREAS,  Dale oversaw the renovation of the former Town Council Chambers in 1989 into the current Town Clerk’s office space and Council Chambers move to its present location on the second floor, along with the renovation of the Town Hall vault in 1994, with restoration of the tin ceiling and preservation of the original wainscoting; and

 

WHEREAS,  as a testament to her professionalism and excellence in managing complex administrative systems, Dale embraced new technologies to improve and modernize the function and efficiency of this municipality, including initiating the implementation of three automated Land Records recording systems, overseeing the conversion from handwritten ledgers and books to the current system in which documents can be electronically viewed immediately.  Conversion to electronic versions of other systems that support the six divisions under her charge were also initiated and implemented during her tenure, including elections, vital statistics, probate and licensing. Notwithstanding this move to computerization, she also maintained the Town’s historic records in excellent, accessible condition preserving these vital documents so important to our community’s legacy; and

 

WHEREAS,  as staff liaison to the Saugatucket Veterans Memorial Park Commission, Dale spent countless hours gathering information and assisting the committee members in certifying the names of veterans to be recognized and honored on the new Veterans Memorial at Saugatucket Park, and again in March 2016, she oversaw the engraving of additional names on the Memorial. Dale also oversaw the restoration of the War Monument located at Hazard School, which was re-dedicated on Memorial Day weekend in 2019; and

 

WHEREAS,  Dale’s professional achievements and leadership extend beyond her service to the Town of South Kingstown. She was designated as a Certified Municipal Clerk by The International Institute of Municipal Clerks (IIMC), having met the rigorous standards established by this venerable institution.  Dale served the Rhode Island Town and City Clerks Association (RITCCA) as Treasurer from 1992-1993, Vice President in 1995 and again in 1996, and President in 1997 and 1998. Dale also served on the Executive Board of the New England Association of City and Town Clerks (NEACTC) from 1987-1988, Secretary from 1988-1989, the Budget Committee from 1991-1992, the Executive Board from 1997-2000, a member of the Legislative Policy Committee from 2000-2001 and the Executive Board from 2001–2004, and served as NEACTC conference treasurer from 2006–2012; and

 

WHEREAS,  Dale is a lifelong resident of South Kingstown, with deep family roots going back to before the 1723 incorporation of the Town. A member of the Daughters of the American Revolution, Dale was raised in her beloved Matunuck, and only left South Kingstown for a stint in New York City before coming back for good; and

 

WHEREAS,  as we celebrate DALE’S career with the Town, she will be remembered for her integrity, utmost professionalism and unwavering dedication to her community. Her trademark signature has traveled around the world on countless birth, death and marriage records, and now she will have the time to travel the world herself, and spend her days enjoying her retirement and time with her husband Karl, as well as her sons Karl Jr. and Thaddeus, both of whom were born and raised during her tenure as Town Clerk.

 

NOW THEREFORE, WE THE TOWN COUNCIL OF THE TOWN OF SOUTH KINGSTOWN, RHODE ISLAND do hereby extend our heartfelt thanks to DALE S. HOLBERTON for her thirty-nine years of dedicated, admirable service to the Town and its residents, particularly to this Council and all previous Councils she served, and extend sincere appreciation for her ability to understand local politics yet never exercise partisan judgments, a true testament to her personal ethics, and we offer our congratulations and best wishes for a happy, healthy and enjoyable retirement.

 

AND FURTHER RESOLVED THAT THE TOWN COUNCIL does hereby confer upon Dale S. Holberton the distinct honor of “Town Clerk Emeritus” in recognition of her many years of selfless service to the Town of South Kingstown.
