Mariann Almonte is present and testifies regarding the programs offered by the Center for the Arts and the history of the license.

 

Discussion ensues relative to the alcohol service area being limited to the interior of the building by the Special Use Permit granted by the Zoning Board, and the scope of alcohol service allowed by State Law under a Class T Legitimate Theater Liquor License. A request for outdoor service of alcohol would be contingent upon Zoning Board of Review and Town Council approval of an expansion of the currently authorized liquor service area. [1]

8.         COMMUNICATIONS

 

A.        UNANIMOUSLY VOTED: that a letter dated September 15, 2021 from Meredith E. Brady, Associate Director of the Department of Administration, Division of Statewide Planning, certifying State approval of the Town of South Kingstown Comprehensive Community Plan 2021 as adopted by the Town Council on May 24, 2021 is received and placed on file. B.        UNANIMOUSLY VOTED: that a letter dated September 24, 2021 from Jennifer Krueger advising of her resignation from the Affordable Housing Collaborative Committee is accepted, and the Town Council directs that a letter of thanks be sent. Video

 

D.        UNANIMOUSLY VOTED: that an email dated October 5, 2021 from Suzan Dunleavy concerning a noise ordinance is received, placed on file, and referred to the Interim Town Manager for a response. Video

 

E.         UNANIMOUSLY VOTED: that an email dated October 6, 2021 from Carol Vetter advising of her resignation from the Trustees of the South Kingstown School Funds is accepted, and the Town Council directs that a letter of thanks be sent. Video

 

9.         COMMENTS FROM INTERESTED CITIZENS Video

 

Council President Collins invites residents to come forward with comments.

 

Councilwoman Rose reads a statement regarding residents being welcome to make comments during this portion of the Council meeting.

 

Joslin Leasca is present and comments regarding statements made at the last Town Council meeting by Nicole Solas, and the Council President’s role.

 

Roberta Mulholland is present and comments regarding public comments at the last Town Council meeting and the treatment of citizens speaking regarding allegations.

 

Councilwoman Bergner moves to add discussion of the State Police Incident Report regarding the AFL-CIO mailer investigation, and communications between the Town Solicitor and Town Council President to the Agenda for discussion; Councilwoman Rose seconds the motion. Councilwoman Kelso opposes discussion regarding the Town Solicitor in his absence. The request is amended to discuss the Town Solicitor’s and Town Council’s roles. It is consensus to discuss these issues after community comments.

 

Nicole Solas is present and comments on the State Police Incident Report on a request that she filed questioning the Town’s mailer investigation report and asking for an investigation by that agency.

 

Kate Johnson is present and inquires about an agreement allowing children of School Department staff who are non-residents to attend school here for free.

 

Councilwoman Bergner comments that a Memorandum of Understanding is in place, and it is

 

UNANIMOUSLY VOTED: that the question of children of School Department staff who are non-residents attending Town schools at no charge be referred to the Town Manager to report back her findings at a future meeting.

 

Gregg Sweet is present and comments regarding transparency issues.

 

Councilwoman Bergner speaks regarding resident’s making public comments at meetings and her ability to ask questions of speakers.

 

Amy Goins, Assistant Town Solicitor advises that public comments at Town Council meetings are for residents to speak to Council members, but if it becomes a discussion on a topic not on the agenda then it should be added to the agenda by majority vote only for discussion purposes, or to refer a matter to staff.

 

Council President Collins comments on the questions asked of him by the State Police with respect to the mailer investigation and the answers he provided to them.

 

Discussion ensues regarding the role of the Town Council President and whether that officer should provide an “interim report” to other members.

 

Discussion ensues regarding Council members’ expectations of the Town Solicitor.

 

Discussion ensues relative to adding the State Police Incident Report and review of the Town Council’s Rules of Conduct to the next Agenda.

 

10.       TOWN MANAGER’S REPORT Video

 

Theresa Murphy, Interim Town Manager notes the upcoming COVID-19 booster clinics that will be held at the South Road School site; the donation of $2,000 to the Emergency Medical Services by Lucy Close; the Town Solicitor’s memo relative to regulation of chickens; re-opening of the Adult Day Care Center; and the proposed budget hearing schedule. The Town Manager’s Interim Report dated September 30, 2021, and the Miscellaneous Report dated October 7, 2021 are accepted, approved and placed on file.

 

11.       APPOINTMENTS

 

A.        UNANIMOUSLY VOTED: to appoint Russell Brown as Alternate #1 to the Zoning Board of Review to fill a term to expire in March 2022. Video

 

B.        Discussion ensues relative to the appointment of Alternate members to the Canvassing Authority. The Council would like additional nominations from the Democratic Town Committee before making an appointment. A motion is made by Councilwoman Bergner to appoint Roland Benjamin as the Republican Alternate, but there is no second. Video

 

12.       NEW BUSINESS

 

C.        UNANIMOUSLY VOTED: to accept for Town ownership and maintenance the roads and associated infrastructure associated with the Sheldon Hill Subdivision.  The roads are identified as Abbey Road and Asbury Lane as depicted in Map Book 2015, Map 29 of the South Kingstown Land Evidence Records.  In support of this action, the developer has provided a $3,346.45 maintenance guarantee to the Town’s Finance Department.  Said guarantee shall be for a period of twelve months for the date of completion and acceptance of work.  This date shall be interpreted to be the same date as the Town Council acceptance of the street.  The developer shall submit a deed, including a legal description for the streets, transferring ownership from Thomas A. Mort to the Town of South Kingstown.  Said deed shall be recorded in the Land Evidence Records of the Town; as further described in a memorandum from the Director of Planning to the Interim Town Manager dated October 6, 2021 and entitled “Street Acceptance of Abbey Road & Asbury Lane and Public Hearing on Associated Stop Signs.” Video

 

D.        UNANIMOUSLY VOTED: to proclaim the month of October to be Dysautonomia Awareness Month, as shown as follows: Video

 

Dysautonomia Awareness Month

 

WHEREAS,    dysautonomia is a group of medical conditions that result in a malfunction of the autonomic nervous system, which is responsible for “automatic” bodily functions such as respiration, heart rate, blood pressure, digestion, temperature control and more; and

 

WHEREAS,    some forms of dysautonomia are considered rare diseases, such as multiple system atrophy and pure autonomic failure, while other forms of dysautonomia are common, impacting millions of people in the United States and around the world, such as diabetic autonomic neuropathy, neurocardiogenic syncope and postural orthostatic tachycardia syndrome; and

 

WHEREAS,    dysautonomia impacts people of any age, gender, race or background; and

 

WHEREAS,    some forms of dysautonimia can be very disabling and this disability can result in social isolation, stress on the families of those impacted, and financial hardship; and

 

WHEREAS,    some forms of dysautonomia can result in death, causing tremendous pain and suffering for those impacted and their loved ones; and

 

WHEREAS,    increased awareness about dysautonomia will help patients get diagnosed and treated earlier, save lives, and foster support for individuals and families coping with dysautonomia in our community; and

 

WHEREAS,    Dysautonomia International, a non-profit organization that advocates on behalf of patients living with dysautonomia, encourages communities to celebrate Dysautonomia Awareness Month each October; and

 

WHEREAS,    we seek to recognize the contributions of the professional medical community, patients and family members who are working to educate our citizenry about dysautonomia.

 

NOW THEREFORE BE IT RESOLVED that the Town Council of the Town of South Kingstown declares the month of October to be Dysautonomia Awareness Month.

 

E.         UNANIMOUSLY VOTED: to authorize the purchase from Stryker Inc., 11811 Willows Road NE, Redmond, WA 98052 of a LUCAS 3 CPR Compression device in an amount not to exceed $10,276; and as further described in a memorandum from the Chief of Emergency Medical Services to the Town Manager dated September 28, 2021 and entitled “Lucas3 CPR Device Purchase Recommendation.” Video

 

F.         UNANIMOUSLY VOTED: to reject the sole bid from Fire Equipment, Inc., 11 Industrial Drive, Smithfield, RI 02917 for Fire Alarm, Fire Extinguishers, Sprinkler & Suppression Systems Inspection, Testing, Maintenance & Repairs in accordance with Bid #SK0008CD; as further described in a memorandum from the Fire Alarm Superintendent to the Interim Town Manager dated October 1, 2021 and entitled “Award of Bid – Fire Alarm, Fire Extinguishers, Sprinkler & Suppression Systems Inspection, Testing, Maintenance & Repairs.” Video
