The Town Council interviews Christopher Little concerning his interest in being reappointed to the South Kingstown Housing Authority.
James M. Manni, Town Manager reviews the License Items on this evening’s Agenda beginning with Item 6A concerning an application for a new Victualling License by Mahachai, LLC d/b/a Tong Ta Thai Restaurant. The applicant is unable to attend, and it is requested that this item be continued to the next meeting.
License Item 6B concerns an application for new Victualling, Holiday Sales and Theater Licenses by All South County Luxury Cinemas, LLC d/b/a All South County Luxury Cinemas.
The Town Manager reviews the Public Hearing items on this evening’s Agenda beginning with Item 7A concerning applications for renewal of licenses to sell intoxicating beverages.
Public Hearing Item 7B concerns an application to transfer the Class B Victualler Liquor License held by Heng-D d/b/a Tong-D Restaurant by Angie H. Lim, Member to Mahachai, LLC d/b/a Tong Ta Thai Restaurant by Awut Chunlawat, Member. The applicant is unable to attend, and it is requested that this item be continued to the next meeting.
Public Hearing Item 7C concerns an application for a new Class B Victualler Liquor License by All South County Cinemas, LLC d/b/a South County Luxury Cinemas by Harold L. Blank, Managing Member.
Public Hearing Item 7D concerns an application for renewal of an Indoor Shooting Range License by IDGR15, LLC d/b/a Elite Indoor Gun Range, by Mark A. Fay, Member.
The Town Manager reviews Communication Item 8A concerning a letter from Susan Cohen and a letter, position statement, and petition from Lynne Harper on behalf of the Friends of Town Farm Park requesting that the Town retain Town Farm Park as a fully recreational area. Mr. Manni notes that Luke Murray, Director of Administrative Services, Jamie Rabbitt, Director of Planning, and a representative from South County Hospital will be present to answer questions.
Council President McEntee states that Communication Item 8A will be brought forward after the Consent Agenda and public comments on this matter will then be allowed.
The Town Manager notes that his report on Town Farm Park will be covered during Communication Item 8A. Mr. Manni reviews the petition that was received from the Friends of Town Farm Park consisting of 110 wet signatures, 220 electronic signatures from South Kingstown residents, and 714 electronic signatures from non-residents. Mr. Manni further notes that Luke Murray, Director of Administrative Services will provide an update on the School Building Committee during the Town Manager’s Report.
The Town Manager reviews the New Business Items on this evening’s Agenda, beginning with Item 12B concerning an award of contract to Enviro Clean Restore for property cleanup in an amount not to exceed $24,800. Mr. Manni reviews the poor condition of a residential property in Town including the accumulation of unregistered vehicles, boats, campers, trailers, tires, and debris. The Town filed a complaint with Washington County Superior Court and a Consent Judgment was issued stating that should the owner fail to abate and correct the violations by June 1, 2022, the Town shall be authorized to enter the property and dispose of the vehicles and materials in a manner the Town sees fit. It is noted that the owner is liable for the costs associated with the corrective measures and a lien will be placed on the property.
New Business Item 12C concerns an award of contract to E.W. Audet & Sons, Inc. for the purchase and installation three 45’ long wooden utility poles and associated guy anchors in an amount not to exceed $6,800 including a contingency of $1,000. Mr. Manni notes that due to the proximity of the dog park in relation to the Broad Rock Playfield, foul balls are frequently hit into the small dog area creating an unsafe environment.
New Business Item 12D concerns authorizing the Tax Assessor to abate taxes in the total amount of $10,749.28, as shown on Tax Abatement Request No. 608.
New Business Item 12F concerns an award of bid to Safety Marking, Inc. for municipal road striping/ marking services at the unit prices bid.
New Business Item 12G concerns an award of contract to Central Maine Pyrotechnics for Fourth of July fireworks displays in 2023 and 2024, in accordance with all bidding specifications, in an amount not to exceed $22,000 per year.
New Business Item 12H concerns a claim for compensation that was filed relative to an incident that occurred on or about August 15, 2022.
New Business Item 12I is relative to the renewal of annual software support fees with Central Square Technologies, LLC for the Police and Emergency Medical Services Division for the period January 1, 2023 to December 31, 2023, in an amount not to exceed $24,005, along with the option to renew annually for four (4) additional years if it remains in the department’s best interest to do so, and provided the annual fee does not increase more than 10% over the prior year.
New Business Item 12J concerns an award of bid to McGovern Municipal HQ for one (1) 2022 Ford Police Interceptor Utility AWD and one (1) 2022 Ford Explorer XLT 4WD vehicle, in accordance with pricing per the Greater Boston Police Council (GBPC) contract through the Massachusetts Metropolitan Area Planning Council, in an amount not to exceed $68,657. It is noted that both vehicles are necessary, and that the Town takes part in the GBPC contract in order to take advantage of lower prices at a regional scale.
It is clarified that purchases under $10,000 and items that are routine in nature are placed on the Consent Agenda. Further discussion ensues relative to reaching out to the dog park association for potential cost sharing of the netting at the dog park. Theresa Murphy, Director of Leisure Services clarifies that the dog park association identifies and funds their own improvements, and the netting at the dog park was adopted as a part of the Town’s Capital Improvement Program.

A. The Town Manager reviews the Town Farm Park land transfer proposal. The proposal involves South County Hospital (SCH) obtaining a parcel for additional parking and in exchange SCH would purchase approximately 30 acres of Glen Rock Road to transfer to the Town. It is noted that for land to be transferred, it must be of equal or more value in order for the land swap to take place and must go through State and federal approvals due to the federal funding the Town received for the Town Farm Park parcel. Mr. Manni also reviews the previous transfer of a portion of Town Farm Park to the hospital in 1983.
Luke Murray, Director of Administrative Services is in attendance and gives a presentation on the Town Farm Park property history and land transfer proposal. In 2019 SCH proposed the land swap to the Town to have space for additional hospital parking. It is noted that Town Farm Park is a 6F property under the federal Land and Water Conservation Fund that stipulates the land be held for open space unless it is swapped for another comparable property. In 2020 the Town Council authorized the Town to submit an application to the RI Department of Environmental Management (RIDEM) for an environmental screening for the proposed land swap. RIDEM would then review the presented information and appraisals before a recommendation could be made to the National Park Service for approval of a land swap. Mr. Murray reviews the application process for the environmental screening with RIDEM. It is noted that RIDEM would look at the land for comparable recreation value and not the underlying historical significance.
Discussion ensues relative to the Council’s vote to submit the application to RIDEM in 2020, the archaeological study, the potential of the area being a Native American burial site, and the comparability of the Glen Rock Road property.
James Rabbitt, Director of Planning is in attendance and gives a presentation on the SCH Institutional Master Plan and archaeological study findings. Mr. Rabbitt reviews the requirement for SCH to file a master plan prior to any major changes and notes that the Town Council approved regulatory changes in the Zoning Ordinance in the spring of 2022. SCH then submitted a new 5-year master plan that identifies their parking constraints and in November 2022 the Planning Board approved SCH’s Institutional Master Plan which is a long-range planning document that does not grant any permits to build or construct anything. It is noted that RIDEM required SCH to have an archaeological study done on Town Farm Park in 2021 and the study was not done by the Town or by the State. The archaeological study done by SCH is not a public disclosable record. Mr. Rabbitt references a letter received in November 2020 from the RI Historic Preservation and Heritage Commission (RIHPHC) requesting an update on where the project stands, and that the Town reach out to Narragansett Tribe which occurred in October 2022. It is clarified that there is no statement in the archaeological study that indicates evidence of burials on the site, there is evidence of burial sites to the north and to the south of the site.
Discussion ensues relative to potential burial sites, and the value of the properties being proposed for a land swap. Further discussion ensues relative to stormwater concerns, alternative parking solutions for SCH, and the decrease in primary care doctors at the hospital.
Lynne Harper is present on behalf of the Friends of Town Farm Park and comments on the position statement and petition submitted to the Town requesting that the Town retain Town Farm Park as a fully recreational area. The group has concerns about the historical and Native American cultural significance of the property, alignment with the Town’s Comprehensive Community Plan, environmental and stormwater mitigation concerns, and that alternative parking options could be explored.

The Town Manager notes that the Town will begin meeting with South County Hospital this week to discuss potential alternatives for additional parking.
Mr. Manni provides a brief update on the School Building Committee (SBC). The SBC is currently narrowing down options to address school facility needs and Luke Murray, Director of Administrative Services will present the proposed options to the Town Council at their next meeting for input. It is noted that the School Committee presides over the approval of the chosen project and the Town Council provides direction and evaluates financial support.
UNANIMOUSLY VOTED: to reappoint Christopher Little to the South Kingstown Housing Authority for a term to expire in October 2027.

D. UNANIMOUSLY VOTED: to authorize the Tax Assessor to abate taxes in the total amount of $10,749.28, as shown on Tax Abatement Request No. 608.

UNANIMOUSLY VOTED: to authorize an award of bid to Safety Marking, Inc., 255 Hancock Avenue, Bridgeport, CT 06605 for municipal road striping/ marking services at the unit prices bid; and as further described in a memorandum from the Public Services Director to the Town Manager dated November 10, 2022 and entitled “Bid Recommendation – Regional Road Striping Contract, FY 2022-2023 & FY 2023-2024.”
G. UNANIMOUSLY VOTED: to authorize an award of contract to Central Maine Pyrotechnics, PO Box 322, Hallowell, ME 04347 for Fourth of July fireworks displays in 2023 and 2024, in accordance with all bidding specifications, in an amount not to exceed $22,000 per year; and as further described in a memorandum from the Director of Leisure Services to the Town Manager dated November 15, 2022 and entitled “Bid Recommendation – Fourth of July Fireworks Display.”
I. UNANIMOUSLY VOTED: to authorize the renewal of annual software support fees with Central Square Technologies, LLC, 12709 Collection Center Drive, Chicago, IL 60693 for the Police and Emergency Medical Services Division for the period January 1, 2023 to December 31, 2023, in an amount not to exceed $24,005, along with the option to renew annually for four (4) additional years if it remains in the department’s best interest to do so, and provided the annual fee does not increase more than 10% over the prior year; and as further described in a memorandum from the Chief of Police to the Town Manager dated November 23, 2022 and entitled “Central Square Technologies LLC – Renewal of Annual Software Support Fees.”
J. Discussion ensues relative to the coloring and marking of police vehicles, and it is
UNANIMOUSLY VOTED: to authorize an award to McGovern Municipal HQ, 1200 Worcester, MA 01702 for one (1) 2022 Ford Police Interceptor Utility AWD and one (1) 2022 Ford Explorer XLT 4WD vehicle, in accordance with pricing per the Greater Boston Police Council (GBPC) contract through the Massachusetts Metropolitan Area Planning Council, in an amount not to exceed $68,657 as further described in a memorandum from the Police Chief to the Town Manager dated November 23, 2022, and titled “Award Recommendation – Ford Explorer Vehicles”.
