A.    Ordinance No. 11-24: An ordinance to amend the Zoning Code and the Map attached thereto by changing the zoning of 1400 West Main Street Inlot 4646 (+/-1.417 acres) from Highway Business (HB) Interim to General    Business (GB) Zoning Classification.  (Introduced by Mr. Kessler)

Summary: This ordinance amends the Official Zoning Map and the Zoning Code to reflect the change in zoning district of Inlot 4646 located at 1400 W. Main Street to General Business (GB) Zoning Classification.

B.    Ordinance No. __-24: An ordinance authorizing the City Manager to enter into a contract to sell a portion of the Broadway Street right-of-way, Tipp City, Ohio to JNZ Rentals LLC, based on the conditions of the attached agreement.  (Introduced by Mr. Slagel)

Summary: This ordinance authorizes the City Manager to sell a portion of the right-of-way to JNZ Rentals LLC, for their use for private parking.

Resolutions (one reading required)  

A.    Resolution No. 12-24: A resolution authorizing the City Manager to purchase playground equipment from Penchura, through the State of Ohio Purchasing Plan at a cost not to exceed $78,943.89.

Summary: This resolution authorizes the City Manager to execute contracts for the purchase of playground equipment in the amount of $78,943.89.

B.    Resolution No. 13-24: A resolution authorizing the City Manager to purchase two trucks for the Street and Electric Departments from Beau Townsend Ford, through the State of Ohio Purchasing Plan at a cost not to exceed $116,180 and declaring personal property owned by the City of Tipp City as surplus property and no longer useful in the general operation of the City.

Summary: This resolution authorizes the City Manager to execute contracts for the purchase of two vehicles from Beau Townsend Ford for a total cost of $116,180.  This resolution also declares two vehicles as surplus property and no longer useful in the general operation of the City.

C.    Resolution No. 14-24: A resolution authorizing the City Manager to purchase one truck for the Street Department from Freightliner, through the State of Ohio Purchasing Plan at a cost not to exceed $104,417 and declaring personal property owned by the City of Tipp City as surplus property and no longer useful in the general operation of the City.

Summary: This resolution authorizes the City Manager to execute contracts for the purchase of one 2.5 ton dump truck through the State of Ohio Cooperative Purchasing Plan for a total cost of $104,417.  This resolution also declares an International 2.5 ton dump truck as surplus property and no longer useful in the general operation of the City.        

D.   Resolution No. 15-24: A resolution authorizing the City Manager to purchase a plow and dump body package for the new 2.5 ton dump truck for the Street Department from Henderson Products, through the State of Ohio Purchasing Plan at a cost not to exceed $115,755.

Summary: This resolution authorizes the City Manager to execute contracts for the purchase of one (1) plow and dump bed package for the new 2.5 ton dump truck at a cost not to exceed $115,755.

E.    Resolution No. 16-24: A resolution declaring the intent to proceed under the Alternative Tax Document Format provided in Section 5705.281 of the Ohio Revised Code and to refrain from the preparation of a tax budget for the Fiscal Year 2025, and authorizing the Finace Director of the City of Tipp City to submit to the Miami County Budget Commission such documents which are necessary to said process, and to take such other actions as may be necessary incident thereto.

Summary: The Ohio Revised Code allows Cities to utilize an alternative format to meet annual tax budget filing requirements of the Miami County Budget Commission.

Ordinances (first reading)

A.    Ordinance No. __-24: An ordinance modifying Code Section 154.03(C)(4)(e)(iii) regarding City Council review and decisions on Zoning Text and Map amendments.

Summary: This ordinance removes the requirement of a 2/3 vote or “supermajority” of Council to modify recommendations by the Planning Board.

-       Council moved to request a public hearing.  Ms. Pittenger and Mr. Slagel voted no.

C.    A motion to make one appointment to the Parks Advisory Board for an unexpired term expiring December 31, 2025.

-       Levi O’Neill was appointed unamiously.

D.   A motion setting May 20, 2024 as the public hearing date for the rezoning of a portion of 4155 Peters Road.

Council welcomes the comments and input of the public during the Council meetings.  In order to provide an orderly fashion in which all interested parties have an opportunity to address Council, Council has adopted the following procedure for citizen’s comments during any portion of the Council meeting or Public Hearing.

 

Any citizen who wishes to address Council must first seek recognition from the President of Council.  Upon recognition by the President, the speaker should approach the podium, state their name and make their comments.  Speakers should not leave the podium to approach Councilmembers without first obtaining permission.  After completion of their comments, Council would request that the speakers return to their seat so that any other interested persons could then be recognized and address Council.

 

The purpose of this procedure is to afford the maximum opportunity for citizen input without any type of disruption of the Council proceedings.  While others are addressing Council from the podium, Council requests that audience members not make comments to Council or to individuals at the podium to prevent any potential confusion or disruption.
