Chapter 26 CEMETERIES[1]

Sec. 26-1. Lot prices.

All cemetery lot prices, including deposits to the perpetual care fund, shall be as established by resolution of the council.

Sec. 26-2. Rules and regulations.

The following rules and regulations are to govern the use of the cemetery properties under the custody or control of the cemetery commission:

(1)     Glass, plastic or spiked vases and pots, artificial flowers and wire blankets are prohibited from cemetery premises from March 1 to November 1.

(2)     From November 1 to March 1, decorations will be allowed on cemetery premises if fastened to base of monument.

(3)     In those locations where plants are allowed, they shall not exceed the height of the monument.

(4)     Any flowers left at grave sites will be removed after five days at the discretion of the cemetery staff.

(5)     Only flat markers shall be allowed on single grave lots. No trees or shrubbery shall be allowed on single grave lots.

(6)     Monuments cannot exceed the height of those in the area and shall be placed in a row.

(7)     Playing of any kind on the cemetery premises is prohibited.

(8)     No candles of any kind are permitted.

Sec. 26-3. Regulations of Pocasset Hill Cemetery parking.

(a)      No person shall park any motor vehicle within the boundaries of Pocasset Hill Cemetery, located at 638 Main Road, unless:

(1)     Attending a funeral service.

(2)     Visiting a gravesite.

(3)     Participating in a cemetery-organized event.

(4)     Performing maintenance or landscaping work.

(5)     On site for any other legitimate purposes approved by cemetery management.

(b)      No person shall park overnight within the boundaries of Pocasset Hill Cemetery.

(c)      The Town of Tiverton is authorized to use an electronic or web-based application to comply, monitor, or enforce any provision of this section.

Sec. 26-4. Penalty.

Any person found to be in violation of any provision of sections 26-3(a), (b), or (c), shall be subject to a fine of $50.00 for each offense in addition to any fees or costs associated with the towing and impoundment of any vehicle.
