Chapter 78 TRAFFIC AND VEHICLES[1]

ARTICLE I. IN GENERAL

Sec. 78-1. Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Vehicle means every device in, upon or by which any person or property is or may be transported or drawn upon a street or highway, except devices moved by human power or used exclusively upon stationary rails or tracks.

Sec. 78-2. Placement of traffic-control devices.

(a)      Whenever official traffic-control devices are placed in position approximately conforming to the requirements of this chapter, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence.

(b)      Any official traffic-control device placed pursuant to the provisions of this chapter and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this chapter unless the contrary shall be established by competent evidence.

Sec. 78-3. Throwing glass, nails, other objects on street.

No person shall throw or deposit upon any street or highway any glass bottle, glass, nails, tacks, wire, cans or other substance likely to injure any person or animal or damage any vehicle on the street or highway.

Sec. 78-4. Violations; penalties.

Unless another penalty is expressly provided by law, every person convicted of a violation of any provision of this chapter shall be punished in accordance with section 1-7.

ARTICLE II. OPERATION

Sec. 78-31. Trucks exceeding four tons in overall weight prohibited from using certain streets.

In accordance with the authority vested by G.L. 1956, § 31-25-26, the following designated streets and highways within the town, to the extent indicated, are forbidden to use by trucks and vehicles exceeding four tons in overall weight, and the superintendent of the highway department is directed to erect appropriate signs forbidding such use:

Canonicus Street west except for making deliveries on the street.

Hilton Street west except for making deliveries on the street.

Russell Drive except for making deliveries on the street.

Warren Avenue except for making deliveries on the street.

Hooper Street except for making deliveries on the street.

Merritt Avenue except for making deliveries on the street.

Durfee Road except for making deliveries on the street.

Beardsworth Road except for making deliveries on the street.

East Beardsworth Road except for making deliveries on the street.

Kenyon Road except for making deliveries on the street.

For the purposes of this section a "commercial motor vehicle" will be defined as a motor vehicle, or combination of vehicles, used to transport passengers or property if the motor vehicle:

(1)     Has a gross combination weight rating of 26,001 or more pounds, of a towed unit with a gross vehicle rating of more than 10,000 pounds, or has a gross vehicle weight rating of 26,001 or more pounds;

(2)     Is designed to transport 16 or more passengers, including the driver; or

(3)     Is transporting hazardous materials as defined in this section.

"Hazardous materials" means any material that has been designated as hazardous under Part 172 of Title 49 of the Code of Federal Regulations, referred to as 49 CFR 172 or any quantity of a material listed as a select agent or toxin in Part 73 of Title 42 of the Code of Federal Regulations, referred to as 42 CFR 73 as they may be revised from time to time.

Sec. 78-32. Maximum speed limit.

The maximum speed limit on all town roads shall be 25 miles per hour, unless otherwise posted.

Sec. 78-33. Reduced speed at certain intersections—Generally.

Upon the basis of an engineering and traffic investigation, it is hereby declared that the prima facie speed permitted under G.L. 1956, § 31-14-2 at the intersections specified in section 78-34 is greater than is reasonable or safe under the conditions found to exist at such intersections, and that the reasonable and safe prima facie speed limit at such intersections, which shall be effective at all times, is 15 miles per hour.

Sec. 78-34. Same—Streets enumerated.

Pursuant to the provisions of section 78-33, no person shall drive a vehicle at any time on the following named streets, or portions of such streets in the Garden Heights Plat, in excess of 15 miles per hour:

Arbor Terrace, within 100 feet of the intersections of Arbor Terrace with Ash Avenue, Beech Avenue, Cypress Avenue, Evergreen Avenue, Fir Avenue, Pine Tree Road, Seaview Court, Spruce Avenue and Garden Avenue.

Ash Avenue, within 780 feet of the intersection of Ash Avenue and Arbor Terrace.

Ash Avenue, within 1,050 feet of the intersection of Ash Avenue and Redwood Road.

Beech Avenue, within 780 feet of the intersection of Ash Avenue and Arbor Terrace.

Beech Avenue, within 1,050 feet of the intersection of Beech Avenue and Redwood Road.

Cypress Avenue, within 1,365 feet of the intersection of Cypress Avenue and Arbor Terrace.

Evergreen Avenue, within 1,365 feet of the intersection of Evergreen Avenue and Arbor Terrace.

Fir Avenue, within 1,365 feet of the intersection of Fir Avenue and Arbor Terrace.

Garden Avenue, within 320 feet of the intersection of Garden Avenue and the Main Road.

Pine Tree Road, within 400 feet of the intersection of Pine Tree Road and Arbor Terrace.

Sec. 78-35. Same—Signs to be erected.

The director of public works shall erect appropriate signs giving notice of the speed limits established by section 78-34.

Sec. 78-36. Speed limits.

(a)      A public hearing shall be held on a proposed 35 mile per hour speed limit on Brayton Road from the intersection of Bulgarmarsh Road south on Brayton Road to the intersection of King Road in north and south directions.

(b)      Fish Road shall be zoned at 35 miles per hour from the intersection of Bulgarmarsh Road to the intersection of Eagleville Road north and south lanes. The intersection of Eagleville Road north to the state line shall be zoned at 25 miles per hour, north and south lanes of travel.

(c)      A 35 miles per hour zone shall be made on Brayton Road, north and south lanes of travel, starting at the intersection of Route No. 177 south to King Road.

(d)      A 35 miles per hour zone on Lake Road starting at the intersection of Lafayette Road to the Little Compton Town Line, north and south lanes of travel shall be established.

(e)      King Road shall be zoned at 35 miles per hour in both the east and west lanes of travel.

East King Road shall be zoned at 20 miles per hour.

(f)       A 25 miles per hour speed limit shall be placed on Tower Hill Road and Coral Lane.

(g)      Speed limits on Fogland Beach Road and Three Rod Way at Fogland Beach shall be established at ten miles per hour.

Sec. 78-37. Stop streets.

(a)      Three-way stop signs shall be placed on Kaufman and Sisson Roads at the following locations:

(1)     The first stop sign shall be placed at the intersection of Kaufman and Sisson in the westbound lane of travel.

(2)     The second stop sign shall be placed on the west side of Sisson and Kaufman Roads.

(3)     The third stop sign shall be placed ten feet back from the intersection of Sisson, south side in the eastbound lane of travel.

(b)      The placement of stop signs shall be at the following locations:

(1)     On East Kenyon at Fish Road, eastbound lane.

(2)     On Beardsworth at Fish Road, eastbound lane.

(3)     On Hope Street at Kenyon Road, southbound lane.

(4)     Tower Hill Road at Brayton Road, eastbound lane.

(5)     Coral Lane at Brayton Road, eastbound lane.

(6)     Paris Avenue at Fish Road, eastbound lane.

(7)     Russell Drive at Fish Road, eastbound lane.

(8)     Merritt Drive at Fish Road, eastbound lane.

(4)     Tower Hill Road eastbound at the intersection of North Brayton Road.

(5)     Seapowet Avenue on the west side at the intersection of Neck Road.

(e)      Stop signs shall be placed at the following locations:

(1)     On Cliff Street at the intersection of Chase Avenue, northbound lane.

(2)     On Cliff Street at the intersection of Chase Avenue, southbound lane.

(3)     On Cliff Street at the intersection of Hilton Street, southbound lane.

(4)     On Church Street at the intersection of Hilton Street, northbound lane.

(5)     On Bottom Street at the intersection of Hilton Street, southbound lane.

(6)     On Hilton Street at the intersection of Bay Street, westbound lane.

(7)     On Chase Avenue at the intersection of Bay Street, westbound lane.

Sec. 78-38. Driving over fire hose.

No vehicle shall be driven over any unprotected hose of a fire department when laid on any street or highway or private driveway to be or being used at any fire or alarm of fire, without the consent of the fire department official in command.

ARTICLE III. STOPPING, STANDING AND PARKING[2]

DIVISION 1. GENERALLY

Sec. 78-61. Nonresidential parking penalties for violation of article.

The parking of any vehicle in a manner contrary to the provisions established in sections 78-64—78-85 shall be fined $20.00, and the vehicle may be towed at the owner's expense to a designated impound lot pending the payment of any outstanding fines and penalties.

Sec. 78-62. Payment—Without personal appearance.

Any member of the town police department and any other duly authorized law enforcement officer who charges any person with an offense as set out in this article shall, in addition to issuing a summons for the offense, provide the offending operator with a form which, when properly executed by the officer and the offender, will allow the offender to dispose of the charge without the necessity of personally appearing before the municipal court. This article shall apply to resident and nonresident operators.

Sec. 78-63. Same—Method.

If the offending operator desires to dispose of the charge without personally appearing before the municipal court, he may execute the form indicated and return it to the clerk of the municipal court of the town not later than 14 days from the date of the summons either by mail or by delivering it to the clerk's office, together with payment of the amount of the fine indicated on the form. If such fine is not paid within 14 days, such fine shall double. If such fine is not paid by mail within 28 days, such fine shall triple. Owners of vehicles with accumulated parking fines and penalties of $200.00 or more may have their vehicles towed at the owner's expense to a designated impound lot, pending payment of any outstanding fines and penalties.

Sec. 78-64. Obstructing traffic.

No person shall stop, stand or park any vehicle upon a street or highway in the town in such a manner or under such conditions as to leave less than ten feet of the width of the roadway for the free movement of vehicular traffic, except that a driver may stop temporarily during the actual loading or unloading of passengers or when necessary in obedience to traffic regulations or traffic signs or signals or a police officer.

Sec. 78-65. Parallel and angle parking.

(a)      Except where otherwise marked or signed, no person shall stand or park a vehicle on a street or highway other than parallel with the edge of the street or highway, headed in the direction of traffic, and with the curb side wheels of the vehicle within 12 inches of the edge of the roadway.

(b)      Upon those streets which have been marked or signed for angle parking, vehicles shall be parked at the angle to the curb indicated by such mark or sign.

(c)      Parking on angle is permitted from ten feet west of the west curbing of Bay Street at the intersection of State Avenue and extending 110 feet west and terminating at this distance. Parallel parking shall be in use for the remaining portion of State Avenue south.

Sec. 78-66. Prohibited in specified places.

(a)      No person shall stop, stand or park a vehicle, except when necessary to avoid a conflict with other traffic or in compliance with the directions of a police officer or traffic control device, in any of the following places:

(1)     On a sidewalk.

(2)     In front of a public or private driveway.

(3)     Within an intersection.

(4)     Within eight feet of a fire hydrant.

(5)     On a crosswalk.

(6)     Within 20 feet of a crosswalk at an intersection.

(7)     Within 30 feet upon the approach to any flashing beacon, stop sign or traffic control signal located at the side of a roadway.

(8)     In front of any place of public worship (while any service is being carried on) except worshippers.

(9)     Within 50 feet of the rail of a railroad crossing.

(10)   Within 20 feet of the driveway entrance to any fire station and on the side of the street or highway opposite the entrance to any fire station within 75 feet of such entrance.

(11)   Alongside or opposite any street or highway excavation or obstruction where such stopping, standing or parking would obstruct traffic.

(12)   On the street or highway side of any vehicle stopped or parked at the edge or curb of the street or highway.

(13)   Upon any bridge or other elevated structure upon a street or highway.

(14)   At any place where official signs prohibit parking.

(b)      No person shall move a vehicle not owned by such person into any such prohibited area or away from a curb such distance as is unlawful.

Sec. 78-67. Parking in excess of 30 minutes between 2:00 a.m. and 6:00 a.m.

No person shall park a vehicle on any street or highway for a period of time longer than 30 minutes between the hours of 2:00 a.m. and 6:00 a.m. of any day, except physicians on emergency calls.

Sec. 78-68. Parking so as to interfere with snow removal.

No person shall park any vehicle on any street or highway so that it will interfere with or prevent the clearing of such street or highway from ice or snow by the highway department. Parking is specifically forbidden on that side of the street on which hydrants are located. On streets on which no hydrants are located, parking is specifically forbidden on the north side of east-west streets and on the east side of north-south streets when the chief of police shall issue a no parking snow warning over local radio and television.

Sec. 78-69. Owner of vehicle not to permit parking violations.

No person shall allow, permit or suffer any vehicle registered in his name to stand or park on any street or highway in the town in violation of any of the provisions of this article or other ordinances of the town regulating the standing or parking of vehicles.

Sec. 78-70. Standing or parking prohibited on portion of Nanaquaket Road.

No person shall stand or park any vehicle on either side of Nanaquaket Road from the junction of Main Road westerly across the bridge to the point where such road makes a bend and runs southerly.

DIVISION 2. RESIDENTIAL PARKING

Sec. 78-101. Purposes of division.

The council finds and declares that the provisions of this division are enacted for the following reasons:

(1)     Reduce high traffic volumes in certain congested residential districts.

(2)     Protect the residential districts from polluted air, excessive noise and refuse caused by the entry of such vehicles.

(3)     Protect the residents of the residential districts from unreasonable burdens in gaining access to their residence.

(4)     Preserve the character of the districts as predominantly residential districts.

(5)     Preserve the value of the property in the congested residential districts.

(6)     Promote traffic safety and the safety of children and other pedestrians in the congested residential districts.

(7)     Facilitate the movement of traffic in the event of accidents or other disasters by virtue of reduced traffic volumes.

(8)     Promote the peace, comfort, convenience and welfare of all residents, inhabitants and visitors of the town.

(9)     Promote public involvement in the designation of specific residential parking streets in the program.

Sec. 78-102. Definitions.

The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Dwelling unit means a unit of living area arranged, intended or designated to be occupied by a family or group of not more than five unrelated individuals living together as a single housekeeping unit.

Resident means any person who lives, resides or pays real property taxes to the town on real estate or on a structure approved for residential or commercial occupancy and who is the owner of such structure or a tenant therein, or who can demonstrate some other indication of exclusive right of occupancy.

Residential parking district means a contiguous or nearly contiguous area containing public highways or parts of public highways, primarily abutted by residential property or residential and nonbusiness property, such as schools, parks, churches, hospitals or nursing homes. Residential parking districts are enumerated in this division.

Residential parking street means a street or portion of a street within a residential parking district where curbside parking is limited to vehicles properly displaying a residential parking permit authorized by this division. The restriction shall be effective from 7:00 a.m. to 7:00 p.m. daily, May 1 through October 31. Designated streets will be enumerated in this division, as amended from time to time by the procedure provided for in this division.

Sec. 78-103. Penalty for violation of division.

The person who has been found to have parked any vehicle in a manner contrary to the residential parking provisions established in this division shall be fined $20.00 and, at the option of the town police department, the vehicle may be towed at the owner's expense to a designated impound lot, pending the payment of any outstanding fines and penalties.

Sec. 78-104. Designation of districts.

In addition to the other restrictions on parking contained in this Code, the council, by majority vote and upon the recommendation of the chief of police, if requested, may designate a residential parking street at any regularly scheduled council meeting in the same manner that an ordinance is amended.

Sec. 78-105. Designation of parking streets.

(a)      The council may designate a street or portion of a street within a residential parking district as a residential parking street, provided that a petition in a form suitable to the town clerk shall have been filed with the clerk, signed by at least 25 percent of the residents, abutting a specific street, within the residential parking district, requesting designation of that street as a residential parking street.

(b)      After advertisement and notice to all landowners whose property abuts the proposed residential parking street, the petition of the residents of the proposed residential parking street shall be placed on the docket of a regular council meeting. At that meeting, the council shall render a decision on the designation of the proposed residential parking street, provided the council makes a finding that it has sufficient information to make such decision, and the petition properly reflects the concurrence of at least 25 percent of the residents of the proposed residential parking street.

Sec. 78-106. Withdrawal of designation of district or street.

The council may, at any time, upon petition or on its own motion, withdraw the designation of an existing residential parking district or residential parking street in the same manner that an ordinance is amended. Such withdrawal shall become effective 30 days after such vote. Notice of such action shall also be made by advertisement in a newspaper of general circulation.

Sec. 78-107. Posting of permit signs.

(a)      Following the council's affirmative vote to designate a residential parking street, parking signs shall be erected on the residential parking street.

(b)      The sign shall inform a vehicle operator that curbside parking on the street is restricted and unless the vehicle displays a residential parking permit or a general visitor or temporary residential parking permit authorized by this division.

Sec. 78-108. Permits—Issuance.

(a)      Any resident over the age of 16 years may apply for a residential parking permit by completing an application prescribed by the police chief, which application is designed to provide the following information:

(1)     The name and residential or commercial address of the owner of the vehicle;

(2)     The name, residential or commercial address and driver's license number of the principal operator of the vehicle; and

(3)     The make, model, color and registration number of the vehicle.

The driver's license and vehicle registration shall be presented with the application.

(b)      Whenever the police chief shall find that the applicant qualifies under the provisions of this division for a residential parking permit for the vehicle described in the application, upon payment of the currently required fees, he shall issue one resident parking permit in the form of a sticker or other method prescribed by the police chief. The annual fee for a residential parking permit shall be set from time to time by the council, payable at the time of the submission of the application for the permit. The permit shall commence on May 1 and shall terminate on April 30. The fee shall not be prorated, and no portion of any fee shall be refundable.

(c)      The police chief may issue one general visitor pass per dwelling unit on a residential parking street. The visitor vehicle pass shall be valid for a period of not more than eight hours. The general visitor pass shall indicate the year for which the permit pass is valid.

(d)      The police chief shall issue a temporary residential parking permit for use by a bona fide visitor to a dwelling unit on a residential parking street. An application for such a permit shall be made only by a resident of a dwelling unit on a residential parking street on such form as shall be prescribed by the police chief. The fee for a temporary residential parking permit for the same vehicle in a seven-day period shall be set from time to time by the council.

(e)      Owners of service vehicles doing business within the town shall qualify for issuance of temporary parking permits for specified periods of time at the discretion of the police chief. The temporary parking permits shall be in a form prescribed by the police chief and valid only for the period indicated thereon.

Sec. 78-109. Same—Renewal or transfer.

(a)      A holder of a valid permit from the previous year shall be entitled to a new residential parking permit for the current year upon payment of the currently required annual fee and submission of evidence to the director of finance that the holder is still qualified for a residential parking permit.

(b)      The holder of a valid residential parking permit shall receive a new residential parking permit for the purpose of transferring such permit to another qualifying vehicle upon surrender of the holder's existing residential parking permit and completion of a new application.

Sec. 78-110. Same—Use.

(a)      A parking permit shall not guarantee or reserve a parking space, nor shall it excuse the observance of any traffic or parking regulation.

(b)      It shall be a violation of this division for the holder of a residential parking permit to use such permit when the permitholder no longer fulfills one or more of the applicable provisions of this division controlling the issuance of permits.

(c)      It shall be a violation of this division for any person to represent, in any fashion, that a vehicle is entitled to a parking permit authorized by this division when it is not so entitled. The display of a parking permit on a vehicle not entitled to such permit shall constitute a violation of this division.

(d)      It shall be a violation of this division for any person to duplicate or attempt to duplicate a residential parking permit or to display on any vehicle such a duplicate parking permit.

Sec. 78-111. Designation—Districts.

Sec. 78-112. Same—Parking streets.

Designated residential parking streets are as follows:

(1)     Narragansett Avenue;

(2)     Hillside Avenue;

(3)     Lawton Avenue;

(4)     Summitt Avenue; and

(5)     Seaconnet Avenue.

(6)     Bay Street, from the Intersection of Canonicus Street and to the intersection of Judson Street.

(7)     Canonicus Street from the intersection of Bay Street to the intersection of Bottom Street.

(8)     Hooper Street from the intersection of Bay Street to the intersection of Bottom Street.

(9)     Judson Street for a distance of 250 feet from the intersection of Bay Street.

Sec. 78-113. Special events.

Any resident on a residential parking street who sponsors a special function or event, which special function or event shall be limited to five hours in duration, shall notify the town police department at least 24 hours in advance as to the address of the function, appropriate duration of the function and an estimated number of vehicles to be present.

Sec. 78-114. Through traffic; penalty for violation of section.

(a)      The use of motor vehicles in and upon the following streets between the hours of 7:00 a.m. and 4:00 p.m. is hereby prohibited except for individuals living thereon or individuals visiting residences on such streets. Nothing contained in this division shall affect the use of such streets by any fire truck, town public works department truck, police vehicle, ambulance or other vehicle using such streets in any emergency, or any vehicle engaged in delivering goods, merchandise or material to or from any residence, building or lot within the immediate vicinity bordering on such streets. Road signs shall be erected to provide adequate notice to motorists.

(b)      The operation of a motor vehicle contrary to this section shall cause the imposition of a fine of $40.00 per violation.

ARTICLE IV. MINIBIKES

Sec. 78-131. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Minibike means a motor vehicle with two tandem wheels, with solid or pneumatic tires, having a steering bar and a saddle seat.

Operate means the use, putting into action or causing to function of a minibike by a person mounted thereon.

Sec. 78-132. Penalty for violation of article.

Any person that violates any of the provisions of this article shall have his minibike impounded for a period of time not to exceed 14 days at the discretion of the chief of police or his representative. No violation of this article shall be considered a criminal offense or made a matter of court record where the offender is 18 years of age or younger. Any person over 18 years of age violating any of the provisions of this article for the second time, in addition to suffering impoundment of his minibike, may be punished in accordance with section 1-7.

Sec. 78-133. Operation prohibited in certain locations.

It shall be unlawful for any person to operate a minibike in the following locations:

(1)     On the private property of another without the express permission of the owner or occupant of such property.

(2)     On public school grounds, public park property, public playgrounds and public recreational areas.

(3)     On any other property belonging to the town.

ARTICLE V. HANDICAP AND DISABILITY PARKING

Sec. 78-136. Parking restricted—Handicap parking, certificate required.

No person shall park any vehicle at any time except for a person with a handicap-parking certificate in the marked restricted space at the following residential locations:

(1)     23 Clement Street—Adjacent to the residential driveway curb cut.

(2)     8 Clement Street.
