ZONING BOARD OF APPEALS MINUTES MARCH 2, 2022

The following petition was received and heard by the Tiverton Zoning Board of Appeals on Wednesday, March 2, 2022 at 7:00 p.m., on Zoom.

Members present: Chairwoman Lise Gescheidt, Vice Chairman David Collins, Ms. Wendy Taylor Humphrey, Mr. John Jackson, Mr. George Alzaibak, and Mr. Edwin Schober (alternate).

Also present were: Mr. Michael Marcello, Esq., Town Solicitor, Mr. Joseph Kaufman, Zoning Official, and Ms. Mary Ann Escobar, Court Stenographer.

The Chairwoman called the meeting of the Tiverton Zoning Board of Appeals to order at 8:58 p.m.

1) Zoning Appeal:

A petition has been filed by Rosalind Weir, PO Box 98 Adamsville, RI. 02878, pursuant to Article XV Section 3a for the appeal of Four Corners Properties, LLC, 28 East Road (Plat 706-Lot 111) R-80 zone from a decision and violation notice from the Building Official/Zoning Official dated September 27, 2021 related to the holding of weddings at the site in violation of zoning and the construction of a tent without the proper permit.

DECISION: Rosalind Weir, applicant, Rob Stolzman, Esq., Kyle Lynch, Esq., and Alyssa Wood appeared before the Board on behalf of the petition.

The Chairwoman stated that this matter would not be heard. The zoning office received a two-hundred (200) page filing for this petition the day prior to the meeting, and submissions were required ten (10) days before a hearing. The Board and Town solicitor could not be expected to review and prepare a response in such a short time, especially for a complicated case with a long history.

Mr. Stolzman said that most of the documents within the late submission were already on file, he was just providing additional information. He asked if this matter could be heard prior to the next regularly scheduled meeting in April.

The Chairwoman stated that the Board needed adequate time to review all of the documentation and this would be continued at the next regular meeting on April 6.
