The Town Council of the Town of Warren, State of Rhode Island in Bristol County met on Tuesday, the 12th day of December, 2017 the meeting was called to order at 7:00 PM.

An ordinance in amendment of the Code of the Town of Warren, Chapter 11 (2nd treading).
Chapter 11, Article II, Section 11-28 of the Code of the Town of Warren is hereby amended to read as follows:
Article II, Alcoholic Beverages, Taverns and Victualling Houses, Division 1, Generally
Sec. 11-28 -- Limitation on number of class B liquor licenses.
Pursuant to the provisions of section 3-5-16 of the General Laws, the town council hereby limits the maximum number of class B liquor licenses as follows:
(1) The maximum number of Class BV beverage licenses to be issued by the town is fixed at twenty-three (24) twenty-five (25).

Public Hearing for a Class BV Beverage License

Solicitor DeSisto recused himself. Attorney Leach represents the Town of Warren with this Public Hearing Only.
David Caetano states his intentions are to continue as a theatre, live venue and with a bar, but he states he has been told he is not a theatre anymore and is trying to upgrade to a BV Beverage License.
Police Chief Achilli states that the Town Manager, Fire Chief and himself met with the applicant regarding some minor issues that they are going to monitor and the applicant was very receptive to their ideas and has no objection at this time.
Attorney Leach states when he was a theatre he was a non-profit and now he is getting a BV License and will be operating as a business and the business does not have the purposes that the non-profit is allowed, so technically he has the wrong corporate structure. If the board is inclined to allow it, his suggestion would be is to convert his non-profit to a corporation LLC or starts new venture within so many days subject to providing evidence to the clerk that he has changed it.
Motion by Councilman Stanley, seconded by Councilman Thompson to close the Public Hearing. Motion passed unanimously.
Motion by Councilman Hanley, seconded by Councilman Thompson to grant the BV License on the condition that the applicant provides the clerk of the change of the corporate structure and to also continue his T License for thirty days pending the change. Motion passed unanimously.

*Lot size must exceed 20 acres.
*Renewable Energy- Utility Scale Facility – means the equipment and requisite hardware that provide and are used for collecting, transferring, converting, storing, or using renewable resources for water heating, space heating, cooling, generating electricity, and off-loading said electricity to the grid, or other applications that would otherwise require the use of a conventional source of energy such as petroleum products, natural gas, manufactured gas, or electricity produced from a nonrenewable resource. The primary use of a renewable energy utility scale facility is to provide energy for the commercial facility on which said facility is located or to produce energy solely to off-load electricity to the grid. Any excess energy produced by a commercial facility may be off-loaded to the grid.
1. Solar Photovoltaic Installation – Utility Scale Facility shall comply with the following:
(a) No individual panel within a ground-mounted solar photovoltaic installation shall exceed 15 feet in height, as measured from pre-development lot grade at the location of the panel;
(b) All panels and other equipment and structures that are part of the installation shall be setback from all property lines as set forth in 32-77 and 32-78;
(c) A ground- mounted solar photovoltaic installation shall not be subject to the floor to area ratio standard (FAR) as set forth in 32-77 and 32-78;
(d) A roof-mounted solar photovoltaic installation shall not exceed the permitted building height as set forth in 32-77 and 32-78;
(e) A ground-mounted solar photovoltaic installation shall be designed to prevent unauthorized access, including, but not necessarily limited to protective fencing.
2. The Zoning Board of Review may not grant a permit or variance unless it finds, in writing, that:
(a) The construction of a Solar Photovoltaic Installation – Utility Scale Facility shall be allowed pursuant to this use table if the use complies with all requirements set forth in this chapter. All such facilities shall be constructed and operated in a manner that minimizes any adverse visual, safety, and environmental impacts;
(b) The specific site is an appropriate location for such use;
(c) The use will not adversely affect the neighborhood;
(d) There will not be any serious hazard to pedestrians or vehicles from the use;
(e) No nuisance will be created by the use; and
(f) Adequate and appropriate facilities will be provided for the proper operation of the use.
Applicant consents to Continue until January 9, 2018 Town Council Meeting at 6:00PM for a Public Hearing.

Discussion and action regarding proposed zoning amendments relating to cultivation of Medical Marijuana.
At the November 12, 2017 Town Council meeting, an inventory was requested of available space that could potentially house a marijuana cultivation use should that use become permissible in the Town of Warren. For reference, below is a table taken from the Department of Business Regulation’s application form for licensed cultivators:

On the following page you will find an inventory of vacant commercial properties within the Town of Warren currently listed on the loopnet.com and riliving.com. It must be noted that this is only an inventory of commercial spaces advertised on these websites. There are unadvertised vacant spaces, as well as spaces that are currently occupied but could convert to a cultivator use in the future. Several of the “for sale” properties are currently occupied. DBR prohibits cultivators (and compassion centers) within 1000 feet of an existing school. Town Planner Ms. Michaud spoke briefly regarding the proposed zoning amendments relating to cultivation of Medical Marijuana.
Motion by Councilman Thompson, seconded by Councilman Hanley to continue and see the map with a 100 foot buffer and no buffer in the village business and get an understanding in village business and all the zones which are special use and how many existing B facilities could potentially have 5,000-10,000. Vote 4-1 Councilman Stanley opposed. .
Appeal by Tree Commission, pursuant to section 18-113 of the Tree Ordinance, of Decision by Tree Warden and Town Manager, pursuant to section 18-108 (c) (6)-(8) of the Tree Ordinance, to Remove Tree at 396 Water Street.
Motion by Councilman Thompson, seconded by Councilman Stanley to remove the tree at 396 Water Street. Motion passed unanimously.
Discussion and action Disabled Veterans Tax Exemption Reform. (Steve Skuba)
Tax Assessor Kristopher Leadem met with Mr. Skuba to discuss his findings and his proposal to create a disabled veteran tax credit.
Mr. Skuba proposes raising the tax credit for a qualified veteran (with no disability) from $191 to $350.
Mr. Skuba would also like to create an additional exemption for disabled veteran. He proposes an additional $100 per 10% of disability. So total credit including veteran exemption would be:
0%=$350, 10%=$450, 20%=$550 30%=$650, 40%=$750…..100%=$1,350
Town of Warren has approximately 350 accounts receiving a veteran tax credit and 53 accounts receiving the 100% disability exemption.
Warren currently gives $385 tax credit for those that are 100% disabled.
Cost of raising MV exemption to $350(not including any exemption for disability) to the town would be approximately $56,000, (increase from $61,000 in credits to $117,000)
There is currently enabling legislation in place that would allow Warren to give an additional tax credit of approximately $155 to partially disabled veteran. (44-3-4(4).
Mr. Skuba suggests mailing a letter to the 350 or so accounts that receive a veterans exemption, asking if they are disabled and if so, what percentage.
Motion by Councilman Thompson, seconded by Councilman Hanley to contact our Veterans in the town on their status relating to disability. Motion passed unanimously.
Discussion and action on draft Warren’s Request For Proposals for a Two-part Study of the Bristol Warren Regional School District.
Motion by Councilman Stanley, seconded by Councilman Thompson to approve the two-part study and corporate the changes the Solicitor discussed on page 15, and the draft be sent to Bristol and participate in a joint meeting. Motion passed unanimously.
1. Update, discussion and action on Information Technology Improvements.
Motion by Councilman Thompson, seconded by Councilman Stanley to follow the Town Managers recommendations related to the 365 licenses, to start the RFP process related to the fiber optic and internet service. Motion passed unanimously.
2. Request approval to make position of Grant writer/Project Manager full-time instead of filling position of Wastewater Management District Manager at this time.
Motion by Councilman Thompson, seconded by Vice President Cronin to approve to make position of Grant writer/Project Manager full-time through June 30, 2018. Vote 3-2 Councilman Stanley and Councilman Hanley opposed.

1. Discussion and action on accepting Bull Crossing, a street within Rockland Acres Phase II, by Town Council for maintenance and future improvements, pursuant to Section II-9 of the Warren Subdivision Regulations.
Town Planner states at the Planning Board meeting on October 23, 2017 the Planning Board voted to recommend Town Council acceptance of Bull Crossing, which is a street within the Rockland Acres Phase II subdivision. This street is located off of Rockland Road which was accepted by the Town Council on August 11, 2015. Construction of Bull Crossing is complete.
