            Chapter 32 - Zoning

            Article XII. Nonconforming Development

            Sec. 32-74 Extension (Eliminates the 25% Limit to Expansion of Non-Conforming

            Uses). (2nd Reading)

No nonconforming use shall hereafter be made of any land, building or structure which otherwise conforms to the provisions of this ordinance, nor shall any nonconforming use be expanded or extended into other conforming land, building or structure or portion thereof, except as hereafter provided. The zoning board of review may grant, as a special use permit under the provisions of article V, permission for the extension or enlargement of a nonconforming use up to twenty-five (25) percent of the size of the building or structure thus used. Such an extension or enlargement shall be granted only once and shall be subject to any safeguards or restrictions deemed appropriate by the board. Any other legal nonconforming use of any parcel of land shall not be extended beyond that portion of the lot thus used unless a use variance is granted by the board under the provisions of article IV.

 

ORDINANCE:

Chapter 12- Motor Vehicles and Traffic

Article III Stopping, Standing, and Parking

sec. 12-66. - Designated Fines. (2nd  reading)

 

(a) A fine of twenty dollars fifty dollars ($20.00 $50.00) shall be imposed for the following violations of this article:

           

            (1) Overtime parking;

            (2) Parking in restricted area;

            (3) Double parking;

(4) Parking in fire lane;

(5) Parking on sidewalk;

(6) Parking to obstruct driveway;

(7) Parking within fifteen (15) feet of corner;

(8) Parking with left wheels to curb;

(9) Parking within eight (8) feet of fire hydrant;

(10) Parking in excess of one (1) foot from curb; and,

(11) Parking on marked crosswalk or within an intersection.

 

(b) A fine of twenty-five dollars seventy-five dollars ($25.00 $75.00) shall be imposed for violation of a winter snow parking ban.

 

(c) Payment of the fines set forth in (a), (b) and (c) above may be made in accordance with the

     provisions of section 12-64 of this article.

 

(d) A fee of $40.00 per hour shall be imposed for police detail cruiser.

Chapter 10 -HARBORS AND VESSELSHarbors and Vessels

Article III  -Mooring Regulations

sec. 10-48. – Mooring permit fees. (1st reading)

Mooring permit fees shall be determined by the Town Council based on the recommendation of the Harbor Commission.

Annual fees for vessels twenty-five (25) feet in length. Additional five dollars ($5.00) eight dollars ($8.00) per foot for vessels over twenty-five (25) feet. Note: The following fees are recommended by the Harbor Commission:

Mooring application fee shall be twenty-five dollars ($25.00). forty dollars ($40.00)

Waiting list renewal fee shall be ten dollars ($10.00) twenty-five dollars ($25.00) each calendar year.

Current residential mooring permit holders having more than one (1) mooring will have the additional moorings assessed at the nonresidential rate.

Upon approval of a mooring permit, the full mooring fee shall be due. Residents of the Town Warren and Barrington shall pay residential fees in the Warren River.

Chapter 3- Animals and Fouls

Article II, Dogs

Section. 3-31. -Impoundment Fees (1st reading)

Any dog impounded under the provisions of this article may be reclaimed upon payment by the owner to the town clerk of the sum of ten dollars ($10.00) twenty five dollars ($25.00) per day and the additional sum of two dollars ($2.00) for each day such dog is kept, except that the second reclamation within a one-year period shall incur a fifteen-dollar ($15.00) charge and thereafter, at twenty-five dollars ($25.00) per reclamation and the dog must be licensed prior to accepting the impoundment fee. The town clerk shall require any unlicensed impounded dog to be licensed prior to accepting the impoundment fees.

Sec. 3-39. - Violation notices; charges.

(a)        The animal warden may issue a violation notice to any owner or owners of any                           dog which violates any provision of this article or fails to cause a dog owned or                                 kept by him to be licensed. The violation notice shall inform such person of the                                   particular violation and that he shall pay the following charges:

            Unlicensed Dog (1st Offense)                                    $25.00             $50.00

            Unlicensed Dog ( 2nd Offense)                                  $100.00          

            Vicious Dog                                                               $10.00             $20.00

            Vicious Dog harm to another domestic animal         $10.00             $15.00

            Vicious Dog bites human       (each year)                  $20.00             $30.00

            Dog Waste (non-removal)                                          $25.00             $50.00

Payment shall be made to the town treasurer by mail or in person, within seven (7) days of the date of the violation. If a person refuses or fails to pay the charge within the seven-day period, the town treasurer shall inform the police department, and the person shall be prosecuted in court according to law for such violation.
