Item 1 Approval of Minutes

 

Review and approval of the August 15, 2022 meeting minutes.

Item 2 Amendment of Appendix D of the Code of Ordinances of the Town of West Warwick, Subdivision and Land Development Regulations

 

WHEREAS:  Pursuant to the provision of Sections 17-25 and 17-26 of the West Warwick Land

Development and Subdivision Review Regulations, the Planning Board of the Town of West Warwick is empowered to adopt, modify and amend the West

Warwick Land Development and Subdivision Review Regulations; and

 

WHEREAS:  The Planning Board for the Town of West Warwick has determined that the provisions of Sections 17-19(B) (13) and (14), 17-20(B), 17-37(D) and APPENDIX A of said Regulations should be amended to insure that said Regulations are updated to provide for accurate rules and regulations for the governing of land development and subdivision projects and to control land development and subdivision projects;

 

NOW, THEREFORE, THE PLANNING BOARD OF THE TOWN OF WEST WARWICK HEREBY AMENDS APPENDIX D OF THE CODE OF ORDINANCES OF THE TOWN OF WEST WARWICK, THE WEST WARWICK LAND DEVELOPMENT AND SUBDIVISION REVIEW REGULATIONS, as follows:

 

Sec. 17-19.  General provisions-Public design and improvement standards.

 

(B)      Street design standards. The following design standards shall be followed where applicable by design and construction of any subdivision:

(13)   Front yard trees. Where natural tree growth is determined by the planning board to be

insufficient, the planning board shall require the subdivider to plant front yard trees, appropriate for the terrain, soil and climatic conditions encountered in the subdivision, and in accordance

with the following standards:

 

e.              Planting. Front yard trees shall be planted in holes  no less than 2” above existing grade with an undisturbed base/compacted base and 1 1/2 times as wide as the root ball. Larger excavation  may be required in gravel or sand areas. Trees shall be good quality topsoil or soil conditioned to that quality with sufficient organic matter such as peat moss and a balanced fertilizer. Trees shall be securely double-staked with sturdy stakes of a minimum size of two inches by two inches by six feet (2" x 2"x 6'). All stakes shall be removed one-year after installation. All wire cages, burlap and twine shall be removed from the root ball prior to planting.

 

(14)    Landscaping standards.

berms, woodland, stone walls, paving materials, planters, signage, and street furniture. Areas which may be required to provide landscaping shall include, but are not necessarily limited to the following:

 

(1)         Drainage facilities, such as retention/detention basins, or drainage swales; (2)         Entrance features;

(3)         Open space areas;

(4)         Proposed recreation facilities;

(5)         Buffer areas;

(6)         Lot areas which are disturbed during the construction or where extensive grading removes a significant amount of natural vegetation;

(7)         Areas subject to regrading or stabilization for soil erosion and sediment control purposes.

 

 

Sec. 17-20.   General provisions--Construction and/or improvement guarantees.

 

 

(B)         General procedures.  Before any land development  or subdivision  plan is endorsed by the planning board, and before the recording of any subdivision  plat, the planning board shall be required to approve agreements for the completion of all required improvements. Such agreements may, as determined by the planning board, at the option of the subdivider, take the form of (1)completion of actual construction of all improvements; (2) improvement guarantees, or (3) a combination thereof.

 

 

Sec. 17-37.  Procedure--Meetings; votes, decisions and records.

 

(D)         Votes. All votes of the planning  board shall be made part of the permanent record and shall show the members present and their votes. A decision by the planning board to approve any land development or subdivision application shall require a vote for approval by a majority of the current planning board membership planning board members present at the time of the vote.

 

 

APPENDIX A SPECIFICATION FOR TREE PLANTING IN NEW SUBDIVISIONS shall be repealed and deleted and of no further force of effect and shall be amended and replaced by the following:

Mr. DiFiore stated Appendix D of the Subdivision Regulations were not part of the Code of Ordinances, now they will be as an Appendix item.  The amendments presented for 17-20 and 17-37 are copying State law, bringing the local regulations into compliance with State law.  The language is the same as in the state statute.  Basically West Warwicks will mirror the State regulation.  Mr. Appolonia asked about a quorum and who determines the quorum and Mr. DiFiore said the state statute, the Zoning Board of Review must have five members present to act but only three are required to continue an item.

 

Mr. DiFiore also said when there is an appeal to the Zoning Board they have no authority to substitute judgment for the judgment of the Planning Board, it is strictly based on facts.

Item 3  Recommendation to the Town Council

 

Amending the Code of Ordinances of the Town of West Warwick by adding thereto

Chapter 21 Planning Board and Zoning Board Education

 

Chapter 21  PLANNING BOARD AND ZONING BOARD EDUCATION

 

Sec 21-1, - Purpose. The purpose of this chapter is to establish requirements and standards for initial, biennial, and continuing education programs for members and alternate members of planning board and zoning board performing land planning or zoning functions as authorized pursuant to the general laws.

 

Sec. 21-2.   Applicability.

This chapter shall apply to the following:

(1) All members, including alternate members, of the local planning board or commission authorized pursuant to chapter 22 of title 45.

(2) All members, including alternate members, of the zoning board authorized pursuant to chapter 24 of title 45.

 

Sec. 21-3. - Land use law and planning - required education for planning and zoning board members.

(a) Every current member and alternate member of the planning board and zoning board shall be required to have satisfactorily completed an education program in land use law and planning to be prepared by the director of the department of administration.

(b) The education program pursuant to this chapter shall include an introductory program offered for new or prospective board members and continuing education courses offered for existing board members. Furthermore, the education program shall be sufficient in design and duration to adequately and reasonably address the topic areas related to land use and planning, including all topics determined relevant by the director, and shall consist of no less than three (3) hours of scheduled instruction for the introductory course or courses and no less than one hour of scheduled instruction for any subsequent annual continuing education requirements. Reasonable efforts shall be made by the director to have the course of study structured in such a manner that

a member may satisfy these requirements through a variety of instructional means including, but not limited to: traditional style classroom and seminar training, distance learning, webinars, on- site presentations, and by other means as deemed appropriate by the director. Education program topics to be considered may include, but not be limited to, the following:

(1) History and purposes of planning and zoning;

(2) State laws and local ordinances, rules and regulations applicable to the work of planning and zoning members, including a full review of chapter 53 of title 45 ("Rhode Island Low and Moderate Income Housing Act");

(3) Overview of the functions of the boards, statutory requirements, and the main tools of planning, zoning, and subdivision review;

(4) Role of others in the planning and zoning process (citizens, applicants, planning and zoning staff, and elected officials);

(5) Understanding and interpreting local comprehensive plans in helping to make land use


decisions;

(6) Understanding basic property rights;

 

Sec. 21-4.   Exemptions.

The following persons shall be exempt from the educational requirements established pursuant to this chapter:

(1) The chief municipal officer of the city or town or person designated to serve on a planning board in an ex officio and non-voting capacity.

(2) Any person who offers satisfactory proof of having completed a course of study in land use law and planning within one year prior to the effective date of Title 47. Chapter 70 of the Rhode Island General Laws, that, in the determination of the director of the department of administration (the "director") in consultation with the division of statewide planning, is equivalent to or more extensive than the course offered pursuant to the requirements of this chapter, will be exempt from the initial three (3) hours of training; however, remain subject to annual continuing education requirements. An appointee/re-appointee must file with the city or town clerk a statement explaining why he or she is exempt from the initial introductory training following the effective date of this chapter.

(3) Any person who demonstrates that he or she is certified by the American Institute of Certified Planners (AICP) or has a master's or doctorate degree in planning from an accredited college or university will be exempt from the initial three (3) hours of training; however, remain subject to annual continuing education requirements. An appointee/re-appointee must file with the city or town clerk a statement explaining why he or she is exempt from the initial introductory training following the effective date of Title 47. Chapter 70 of the Rhode Island General Laws.

Mr. DiFiore stated there is no vote required, this is not a recommendation to the Town council, it is only adding a section to the code that codifies the State statute.

 

Item 4  Recommendation to the Town Council

 

Amending Sections 3, 4, 24 and 25 of the West Warwick Zoning Code of the Code of

Ordinances of the Town of West Warwick

 

 

Section 3. Definitions.

 

Where words or terms used in this chapter [ordinance] are defined in section 45-22.2-4 [the definitions section of the "Rhode Island Comprehensive Planning and Land Use Regulation Act"], they shall have the meanings stated therein. In addition, the following words shall have the following meanings:


 Where words or terms used in this chapter are defined in § 45-22.2-4 or 45-23-32, they have    the    meanings    stated    in    those    sections.    In    addition,    the    following    words have the following meanings. Additional words and phrases may be used in developing local ordinances under this chapter;  however,  the  words  and  phrases  defined  in  this  section  are controlling in all local ordinances created under this chapter:

 

 

3.11a    Building height. For a vacant parcel of land, building height shall be measured from

the average, existing-grade elevation where the foundation of the structure is proposed. For an existing structure, building height shall be measured from average grade taken from the outermost

four (4) corners of the existing foundation. In all cases, building height shall be measured to the top of the highest point of the existing or proposed roof or structure. This distance shall exclude spires, chimneys, flag poles, and the like. For any property or structure located in a special flood hazard area, as shown on the official FEMA Flood Insurance Rate Maps (FIRMs), or depicted on the Rhode Island coastal resources management council (CRMC) suggested design elevation three foot (3') sea level rise (CRMC SDE 3 SLR) map as being inundated during a one-hundred-year (100) storm, the greater of the following amounts, expressed in feet, shall be excluded from the building height calculation:

(i) The base flood elevation on the FEMA FIRM plus up to five feet (5') of any utilized or proposed freeboard, less the average existing grade elevation; or

(ii) The suggested design elevation as depicted on the CRMC SDE 3 SLR map during a one-hundred-year (100) storm, less the average existing grade elevation. CRMC shall reevaluate the appropriate suggested design elevation map for the exclusion every ten (10) years, or as otherwise necessary.

 

3.15     Community residence. In accordance with the provisions of G.L. Title 45, Chapter 24, a home or residential facility where children and/or adults reside in a family setting and may or may not receive supervised care. This shall not include halfway houses or substance abuse treatment facilities. This shall include, but not be limited to, the following:

 

3.15.1 Whenever six or fewer mentally disabled or mentally handicapped or physically handicapped children or adults with intellectual and/or developmental disability reside in any type of residence in the community, as licensed by the state pursuant to 42 G.L. 1956, § 40.1-24-1 et seq. chapter 24 of title 40.1. All requirements pertaining to local zoning are waived for these community residences;

 

3.15.2  A group home providing care or supervision, or both, to not more than eight unrelated persons with disabilities, and licensed by the state pursuant to G.L. Chapter 24 of Title 40.1;

 

3.15.3  A residence for children providing care or supervision, or both, to not more than eight children including those of the care giver and licensed by the state pursuant to G.L. 1956, § 42-

72.1-1 et seq.;

 

3.15.4  A community transitional residence providing care or assistance, or both, to no more than six unrelated persons or no more than three families, not to exceed a total of eight persons, requiring temporary financial assistance, and/or to persons who are victims of crimes, abuse, or neglect, and who are expected to reside in that residence not less than 60 days nor more than two years. Residents will have access to and use of all common areas, including eating areas and living rooms, and will receive appropriate social services for the purpose of fostering independence, self- sufficiency, and eventual transition to a permanent living situation.

 

 

3.16     Comprehensive plan. The comprehensive plan when adopted and approved pursuant to Title 45 Chapter 22.2 of the General Laws and to which any zoning adopted pursuant to the act shall be in compliance.

 

3.29         Family. A person or persons related by blood, marriage, or other legal means.

 

 Family member. A person, or persons, related by blood, marriage, or other legal means,  including,  but  not  limited  to,  a  child,  parent,  spouse,  mother-in-law,  father-in-law, grandparents, grandchildren, domestic partner, sibling, care recipient, or member of the household.

 

 

3.60a Overlay district. A district established in a zoning ordinance that is superimposed on one or more districts or parts of districts. The standards and requirements associated with an overlay district may be more or less restrictive than those in the underlying districts consistent with other applicable state and federal laws.

 

 

3.75a   Slope of land. The grade, pitch, rise, or incline of the topographic landform or surface of the ground.

 

 

Section 4. - Division into districts.

 

4.5     Unlisted uses. Any use not listed in the table of uses shall be permitted may be considered a permitted use or a permitted use requiring a special use permit by the zoning board upon favorable recommendation to the zoning board by the planning board and the granting of a special use permit by the zoning board and upon the affirmative finding of each board that the proposed use:

(1)    Is in conformance with the purposes and intent of the town comprehensive plan and the applicable standards of this ordinance; and

(2)   Is either a use of the same type and nature that is generally permitted in the zone in which the use is proposed or that the proposed use is a use of less intense nature that the uses presently permitted in the zone in which the use is proposed; and

 

(3)   Will not alter the general character of the surrounding area; and

 

(4)   Meets the standards required for the granting of a special use permit in section 10.2.1 of this zoning code.

 

 

Section 24. Establishment and procedures of board of review.

 

24.1 There shall be a zoning board of review which shall consist of five members, each to hold office for a term of five years, with one member to be appointed each year by the mayor with the  confirmation  of  the  council.  The  board  shall  choose  its  chairperson  and  said


chairperson[,] or an acting chairperson in his or her absence, may administer oaths and compel the attendance of witnesses. All members and alternate members of said board shall be qualified electors and residents of the town during their term of office and shall hold no other office in the service of the town. Each member shall continue in office until his successor has been duly appointed and qualified.

 

 

The zoning board of review consists of five (5) members, each to hold office for the term of five (5) years.  The zoning board of review also includes two (2) alternates to be designated as the first and second alternate members, their terms to be set by the ordinance, but not to exceed five (5) years. These alternate members shall sit and may actively participate in hearings. The first alternate shall vote if a member of the board is unable to serve at a hearing and the second shall vote if two (2) members of the board are unable to serve at a hearing. In the absence of the first alternate member, the second alternate member shall serve in the position of the first alternate. A minimum of four (4) members, which may include alternates, shall form a duly constituted quorum. No member or alternate may vote on any matter before the board unless they have attended all hearings concerning that matter.

 

 

 

24.1.3      In addition to the five standing members, the town council shall annually appoint two alternates to be designated as the first and second alternate members. These alternate members shall sit and may actively participate in hearings. The first alternate shall vote if a member of the board is unable to serve at a hearing and the second shall vote if two members of the board are unable to serve at a hearing. In the absence of the first alternate member, the second alternate member shall serve in the position of the first alternate. The alternate members shall exercise the same duties and functions of a regular member when serving on the board and may be removed from office by the town council in the same manner as a regular member.

 

24.1.3 Reserved.

 

24.1.4      Annually in the month of September, the zoning board of review shall organize by electing from its membership a chairperson, and vice chairperson., and secretary. The town clerk or his or her designee shall serve as clerk of the board and shall perform such duties as are provided by this ordinance. Meetings of the board shall be held at the call of the chairperson or as may be fixed by the board.

 

Section 25. Power and duties of the zoning board of review.

 

25.1 The zoning board of review shall have the following powers and duties:

 

25.1.1      To hear and decide appeals in a timely fashion within 65 days of the date of filing of the appeal where it is alleged there is error in any order, requirement, decision, or determination  made by an  administrative officer or agency in  the enforcement  or interpretation of this ordinance, or of any amendment adopted pursuant hereto;

 

25.3     All members, including alternate members, of any zoning board shall be required to participate in continuing education courses promulgated pursuant to chapter 70 of title 45 entitled "Continuing education for local planning and zoning boards and historic district commissions", as provided for in CHAPTER 21 PLANNING BOARD AND ZONING BOARD EDUCATION of the Code of Ordinances.

Item 5  Recommendation to the Town Council

 

Amending Sections 2, 3 and 5 of the West Warwick Zoning Code of the Code of

Ordinances of the Town of West Warwick

 

 

Section 2. - General purposes.

 

These  zoning  regulations  are  developed  and  maintained  in  reliance upon  the West Warwick Comprehensive Plan prepared and adopted by the town in accordance with the Rhode Island General Laws and are designed to address the following purposes. The town council recognizes these purposes, each with equal priority and numbered for reference only.

 

2.17       To satisfy the minimal requirements of the State Zoning Enabling Act as set forth in

RIGL §45-24-37(e).

 

 

 

Section 3. - Definitions.

3.2       Accessory family dwelling unit. An accessory family dwelling unit is a unit located entirely within or directly attached to a single-family owner-occupied dwelling unit, that is clearly a subordinate part of the single-family owner-occupied dwelling unit and is designed exclusively as a residence for use of not more than two members of the family occupying the principal single family dwelling unit.

 

3.2       Accessory dwelling unit (ADU). A residential living unit on the same parcel where the primary use is a legally established single-unit or multi-unit dwelling. An ADU provides complete independent living facilities for one or more persons. It may take various forms including, but not limited to: a detached  unit; a unit that is part of  an accessory structure, such as a detached garage; or a unit that is part of an expanded or remodeled primary dwelling.

 

Section 5. - Use regulations.

 

 

The Town of West Warwick is divided into the following mapped districts to implement this ordinance and may include, but are not limited to, the separation of residential from nonresidential uses and the division of nonresidential uses into appropriate areas of the town to achieve the purposes stated in section 2 hereinbefore:

 

5.1  Reserved.  Notwithstanding any other provisions of this ordinance, accessory dwelling units (ADUs) shall be permitted only as provided in section 5.6.16.

 

5.2 Reserved.

 

5.3 Table of use regulations.

5.6.16 An accessory family dwelling unit shall be permitted upon application by the owner in an owner-occupied single-family dwelling for a special use permit pursuant to section 10 provided the following conditions are met:

 

 

5.6.16 Accessory  dwelling  units  shall only  be permitted  as part  of an owner-occupied residence as a reasonable accommodation for family members with disabilities or who are sixty- two  (62} years of age or older, or to accommodate  other family members.  When used in this section the terms family members with disabilities”  means a person who has a physical or mental impairment  that substantially  limits one or more of life activities as defined in R.I.G.L.§42-87-1(7). The intent of this section is to comply with the minimum requirements  of R.I.G.L. § 45-24-37(e) and to prohibit the use of accessory dwelling units beyond the minimum requirements  of R.I.G.L. § 45-24-37(e).

 

5.6.16.1 A valid zoning certificate shall be in existence

 

5.6.16.2 The dwelling to which the accessory family dwelling unit is to be added shall be the only dwelling on the lot.

 

5.6.16.3 No more than one accessory family dwelling unit shall be permitted.

 

5.6.16.4 5.6.16.2 No violations of any of the town's codes or ordinances shall exist on the lot at the time of the application.

 

5.6.16.5 5.6.16.3 The accessory family dwelling unit ADU shall not contain more than two bedrooms.

 

5.6.16.6 5.6.16.4 At least one additional off-street parking space shall be provided for on the lot for the accessory family dwelling unit ADU. Additional parking on the side of the main residence shall be prohibited.

 

5.6.16.7 5.6.16.5 The accessory family dwelling unit shall be constructed in accordance with the plans approved by the zoning board of review Building Official.

 

5.6.16.8 The accessory family dwelling shall be located entirely within or be directly attached to the owner-occupied single-family dwelling and no breeze way shall be allowed between the accessory family dwelling and the principal dwelling.

 

5.6.16.9 The accessory family dwelling shall occupy no more than 50 percent of the total living space of the total owner-occupied dwelling unit, exclusive of a basement, and shall contain no less than 400 square feet and no more than 800 square feet of li ving space.

 

5.6.16.10 No accessory dwelling unit shall be allowed above the second floor of the principal single family dwelling unit.

 

5.6.16.11 The accessory dwelling unit shall have direct access for ingress and egress from the principal single-family dwelling and separate access for ingress and egress to the outside.

 

5.6.16.12 5.6.16.6 All minimum dimensional and set back requirements of the zoning code must be complied with unless a dimensional variance is granted by the zoning board of review.  An ADU shall be permitted in a structure that is a lawfully established pre -existing non-conforming use through a special use permit and no variance shall be required.

 

5.6.16.13 5.6.16.7 The accessory dwelling unit shall not have separate connections to any utilities servicing the accessory family dwelling unit.

 

5.6.16.14 A kitchen area of an accessory dwelling unit be not less than 50 square feet and shall not exceed 75 square feet.

 

5.6.16.15 There shall be no enlargement of the principal single-family dwelling unit or of the accessory dwelling unit without prior approval of the zoning board of review. The granting of a special use permit for an accessory dwelling unit shall be subject to the following:

 

5.6.16.16 5.6.16.8 The use as an accessory dwelling unit ADU shall automatically cease and no longer be valid upon (1) such accessory dwelling unit ADU being occupied by any person other than the family members with disabilities or who are sixty- two (62} years of age or older, orto accommodate  other family members for whom the ADU was created  an immediate family member of the owner occupant of the principal single family dwelling unit or (2) conveyance of the principal single family dwelling unit to any person other than the present owner, whichever shall first occur, provided however, in the event if conveyance of the principal single family dwelling unit to any person other than the present owner and the transferee of such conveyance shall desire to continue that approved accessory dwelling unit ADU without making any changes thereto, such accessory family dwelling unit ADU approval may be continued subject to all prior conditions and stipulations and specifically subject to sections 5.6.19.20, 5.6.19.21 and 5.6.16.22 such  continuation  of  the  approval  of  the  accessory dwelling  unit  ADU  may be  approved administratively in the discretion of the Town Planner.

Mr. DiFiore: This is a recommendation to the Town Council for the Accessory Dwelling Unit. In 2022 there were five to six affordable housing acts passed by the legislature.  Currently the Accessory Family Dwelling states it must be used for a family member and attached to the main house. WW has a great code, well regulated and the ZBR is very strict.  The state has removed the word family.  Mr. DiFiore read the new ADU law…..he also stated the ZBR has been completely removed from it.  The recommendation proposed is for family members with disabilities or are 62 years of age or older and shall be permitted as part of an owner-occupied residence….see full description.
