2.         One-Year Extension of Final Plan Approval - 511 East Greenwich Avenue – Major Land Development

Padula Builders, Inc. applicant, is requesting a one-year extension of the Final Plan Approval of the West Warwick Planning Board.  This application was recorded in the land evidence records on April 19, 2023.   The request for extension would expire April 19, 2025.

 

Thomas Cronin, Esq, introduced the project to the board and asked for the one-year extension of the final plan.

Al DiFiore, Esq., WW Legal Counsel explained to the board that questions have been raised regarding the demolition of the existing vacant dwelling on the property.  The town reached out to the applicant for an explanation and at this time I would like to read an explanation from the applicant at this time.  The email sent April 2,2024 reads as follows:

 

 

“Hi Marilyn and Al,

 

Thank you for your patience on the house demo.  I wanted to follow up with our update.  Demolition permit process is in the works.   There are multiple steps to get the demo permit issued from the town.   The asbestos shingles were removed by a licensed asbestos abatement contractor already.   The current step is getting all the utilities disconnected are removed from the house.  Unfortunately, we are at the mercy of the utility companies.   We need them to disconnect all the utilities from the property and then get written correspondence from them that it was complete and provide that documentation to the building dept for the demo permit.  Normally, it takes multiple calls from them to get the documentation once completed.   KC Water is helping us out big time by allowing us to terminate the water at the curb stop for now.  Complete termination requires us to open the road and disconnect the service at the main 20” pipe in the road.   The main is on the other side of the yellow lines from the house so it would entail shutting the road down.   The pest inspection has been completed and we also have the demo performance bond needed.  Once we have all the documentation needed from the utilities, we will move forward with the demo permit application with the town.   Once issued, the house will be removed within a couple weeks.   Demo will take one to two days once equipment is mobilized.   Our anticipation is for the whole process to be done and house removed by end of May 2024.”

3.         Continuation of Major Land Development – Mill Re-Use, Master, and Preliminary Plan with Informational Public Hearing to Reconstruct the Historic Phenix Mill into 16 Residential Units

David Johnson, Esq. presented the project to the board for 16 residential townhouses that will replicate the Phenix Mill that was destroyed by fire.  He stated that all applications were in with permitting authorities, but final approvals are pending for this application.

 

Attorney Johnson introduced eleven (11) documents into the record.  They are as follows:

1.     Site Investigation Report

2.     Revised site plan

3.     Building elevations

4.     WW Fire Department letter

5.     Revised Fiscal Analysis Report

6.     March 18, flood elevation report

7.     Erosion & Sediment Control Plan

8.     Operation & maintenance plan

9.     Stormwater Management Report

10.  Revised traffic analysis

11.  RIDEM Insignificant Alteration Permit

 

Dan Campbell, P. E., Level Design Group, 249 South Street, Plainville, Mass.  Mr. Campbell updated the board that the flood certificate would be submitted at the building permit certification stage.  Without the certificate no building permit would be issued.

 

David Hasebrook, 719 Cooper Road, Chepachet, RI of Lake Shore Environmental.  He is a geologist and expert in environmental contamination. Mr. Hasebrook explained the sitewide capping rather than infiltration of stormwater required by Rhode Island Department of Environmental Management (RIDEM).  The riverbank buffer is 20-30 feet and will be fenced and be without a cap. Any activity in this area is strictly prohibited. The site will have grass and landscaping.  Cap installation and maintenance will be specified in the Remedial Action Work Plan (RAWP) during construction, and Environmental Land Use Restriction (ELUR) post construction and recorded in the land evidence records. This information will be included in the Condominium documents to be submitted to the Town of West Warwick Legal Counsel, Al DiFiore, Esq. for approval. 

 

The board asked Mr. Hasebrook about several of the chemicals that were found on site.  All explanations were acceptable to the board. 

 

A motion was made by Mr. Villa and seconded by Mr. Coutu to approve the Preliminary Plan.
