F.         Executive Session –

Council may vote to move to Executive Session pursuant to R.I. General Law 42-46-5 (a)(2)– Collective Bargaining or Litigation and R.I. General Law 42-46-5 (a)(3)- Security Personnel

MOTION made by M. Williamson, second by J. Messier to move to Executive Session pursuant to R.I. General Law 42-46-5 (a)(2)– Collective Bargaining or Litigation and R.I. General Law 42-46-5 (a)(3)- Security Personnel.

 

Discussion ensued whether to move into executive session.  The Council determined it would not move into executive session at this time relative to this topic. 

 

M. Williamson withdraws her motion.

 

MOTION made by J. Messier, second by J. Licciardi to table Executive Session pursuant to R.I. General Law 42-46-5(a)(3) – Security Personnel – 01 Ernest Lavigne.                       All Ayes

 

MOTION made by M. Bourget, second by J. Messier to move to Executive Session pursuant to R.I. General Law 42-46-5 (a)(2)– Collective Bargaining or Litigation – 02 Post June 10, 2021 Supreme Court Decision; Town Council’s complete review of Read’s Landscape Construction Inc. v. 4N Properties LLC, KC 2017-1008 (Industrial Drive)

 

Discussion ensued whether it was appropriate to meet in executive session on this topic.  The Solicitor expresses the need to meet in executive session on this topic due to confidential information that will be shared.  The Council determines that it will not meet in executive session on this topic.

 

MOTION made by M. Bourget, second by J. Messier to withdraw the motion to move to executive session.

                                    All Ayes

 

G.        New Business

01        Request from Councilman Bourget for the release of town casefile to the Town Council relative to Read’s Landscape Construction Inc v. 4N Properties LLC; and authorization for payment of any fees associated with this request Video

 

M. Bourget has put in this request to gain access to the casefile.   He would like to review the lawsuit. 

 

T. Williamson explains the process of releasing the file.  Copies would need to be watermarks because they are confidential.  He would need at least ten days to complete the request. 

 

Discussion ensues relative to the cost associated with copying the files.  It was determined that two watermark copies would be made.  One would be given to the Town Manager, and one for Councilman Bourget.

 

MOTION made by M. Bourget, second by J. Messier to authorize the Town Solicitor to make two copies of the entire file of Read’s Landscape Construction Inc v. 4N Properties LLC for M. Knott and M. Bourget and bill the Town Council.

 

T. Williamson will prepare a bill for his services and submit it to the Town Manager for approval.
