L.        DISCUSSION/ ACTION ON JOSHUA PAULEY’S REQUEST ON RETURN OF CONTRIBUTIONS

    a. State of Rhode Island v. Joshua Pauley: Case No. 31-2020-06739

           

1) Pension Plan of Town of West Warwick ( Excluding Police and Fire)

  (a.) Article 6 Conditions for Receiving Benefits: Section 6.03 Dishonesty

   

            2) RIGL 11-43-31 Pension Revocation

     

            3) RIGL 36-10.1-4 RI Public Employee Pension Revocation and Reduction Act

                        Return of Contributions

 

b. Town's Request to WW Pension Board to hold Employee Joshua Pauley's request for return of contributions in abeyance until the completion of the criminal trial currently pending in the Third Division District Court and any potential appeals to the Superior Court.

 

c. Town’s objection to any distribution of a return of contributions to Joshua Pauley by the Pension Board and notice to the Pension Board of their intent to seek a Preliminary Injunction/ Temporary Restraining Order preventing and prohibiting the WW Pension Board from acting on Employee Joshua Pauley's request for return of contributions.

 

Motion made to approve return of contributions with interest but hold distribution  for 30 days by Mr. Atchison and seconded by Ms. Lombardi.

M.       DISCUSSION /ACTION ON DIANE CALCI v. TOWN OF WEST WARWICK KC       2016-0776 

 

N.        DISCUSSION/ACTION ON THE TOWN COUNCIL’S ABILITY TO APPOINT AGENTS FOR ADMINSTRATIVE PURPOSES

DURING AND SUBSEQUENT TO THE TRANSITION INTO THE MUNICIPAL EMPLOYEES RETIREMENT SYSTEM (M.E.R.S)

 

                        Attorney William gave an update on the terms and conditions of the settlement of case the payments of fees will come from the Town and the additional part of Mrs. Calci ‘s being permitted to receive cost of living retro back to 2019 and the reduction of monthly benefit will remain the same.  Mr. Williamson stated the Town agreed with Pension Boards decision with the consent judgement for cost it was beneficial for this settlement for Mrs. Calci.
