        Motion by Mr. Nigrelli, Seconded by Ms. Thoman, that the aforesaid minutes be accepted and approved as printed.  (Voted Unanimously)

        Motion by Mr. Nigrelli, Seconded by Mr. Gencarella, to open the Public Hearing.  (Voted

            Unanimously)

 

        Liquor Class B Victualer – New Video

        Cinder Restaurant LLC

        Present:  William A. Nardone, Esq. representing applicant

 

        Mr. Nardone presented a brief history on the travel of this application.  He noted that the building is well along in construction; that it will have sixty seats including inside and outside seating; and that restrictions imposed by CRMC have been placed on the property under the Urban Coastal Greenway Plan, being a pedestrian easement over the property from Main Street and a twenty-five foot wide easement along the river.  He stated that the hours of operation are 11 a.m. to 11 p.m. and noted the restaurant experience of the applicants.

 

        Mr. Nardone responded to questions from the Board regarding site plan, seating and parking.

 

        No one appeared in favor or to object.

 

Motion by Mr. Nigrelli, Seconded by Ms. Thoman, that the aforesaid license be granted subject to the prior approval of proper authorities.  (Voted Unanimously)

 

        Liquor Class B Victualer – New Video

        18 High Street LLC

               dba: Endswell Inn                                                          12 High St Unit 106 & 107

 

        Present:  William A. Nardone, Esq. representing applicant

                        Jeffrey Pucci, member

 

        Mr. Nardone explained the operation of the business.  He stated that the establishment will have two levels with 142 seats including outdoor seating of 28 seats along the river walk; that there will be two bar areas; and that the hours of operation will be for 7 a.m. to 1 a.m.  He noted the principals of the corporation and provided background on the operators' experience in the industry.  He addressed the floor plan and noted where the liquor will be stored.

 

        Mr. Nardone responded to questions from the Board regarding the floor plan and the river walk.

 

        No one appeared in favor or to object.

 

Motion by Ms. Thoman, Seconded by Ms. Belanger, that the aforesaid license be granted subject to the prior approval of proper authorities.  (Voted Unanimously)

 

        Liquor Class B Victualer – Shareholders Transfer Video

               Mr. Cardiff recused on the aforesaid matter due to a possible conflict of interest being   that he is an abutting property owner.

 

        Present:  Thomas J. Liguori, Jr., Esq. representing applicant

                        Nicholas Scola, transferee

 

        Mr. Liquori stated that the aforesaid application is a stockholder transfer from the Luzzi’s as shareholders to Nicholas Scola as the sole shareholder.  He further stated that the transfer that was granted to Essential Foods LLC is being withdrawn.

 

               No one appeared in favor or to object.

 

Motion by Mr. Nigrelli, Seconded by Ms. Thoman, that the aforesaid transfer be granted subject to the prior approval of proper authorities.  (Voted Unanimously)

 

Motion by Mr. Nigrelli, Seconded by Ms. Belanger, to close the Public Hearing.  (Voted Unanimously)
