Motion by Mr. Nigrelli, Seconded by Mr. Gencarella, that the aforesaid minutes be accepted and approved as printed.  (Voted Unanimously)

a.       Dennis McGouran, Alarm Superintendent – re: Establishments operating without a license due to non-compliance with fire code requirements

Motion by Ms. Thoman, Seconded by Ms. Belanger, to open the Public Hearing.  (Voted   Unanimously)

        Present:  Brian Samuelson, Owner

 

               Mr. Samuelson explained the type of entertainment and its location on the site, and dispelled concerns of the Board regarding potential sound levels in a residential area.

 

Motion by Ms. Thoman, Seconded by Mr. Gencarella, that the aforesaid license be granted subject to the prior approval of proper authorities.  (Voted Unanimously)

 

Motion by Ms. Thoman, Seconded by Ms. Belanger, that the public hearing be closed.  (Voted Unanimously)

Motion by Ms. Thoman, Seconded by Mr. Gencarella, that the aforesaid license renewals be ordered advertised for public heaing on April 14, 2022 (Voted Unanimously)

        Town Solicitor Conley recommended sending a conditional cease and desist letter to the aforesaid advising them that if they do not come into compliance or appear at the next Licensing Board meeting, they must cease operations.

 

Motion by Ms. Thoman, Seconded by Mr. Nigrelli, that the aforesaid establishments be contacted to appear before the next Licensing Board meeting on March 10, 2022, to explain their failure to renew their license, and if they fail to comply within thirty days, they will be issued and order to cease and desist operations. (Voted Unanimously)

         Mr. McGouran noted that the above establishments have not come into compliance with state requirements relating to fire alarm testing reports or payment of inspection fees

 

         Town Solicitor Conley advised that a conditional cease and desist can be sent to the aforesaid contingent upon making an agreement with the Fire Marshal, and, if they do not comply, they must appear before the Licensing Board and cease operations. 

 

Motion by Ms. Thoman, Seconded by Mr. Gencarella, that the aforesaid establishments be sent a conditional cease and desist contingent upon making an agreement with the Fire Marshal within thirty days. (Voted Unanimously)

 

               FMC Certificate:

                        Sunnyside Up                                     253 Post Rd

 

Motion by Ms. Thoman, Seconded by Mr. Gencarella, that the aforesaid establishment be sent a conditional cease and desist contingent upon the filing of a Food Manager Certificate with the Town Clerk's office within thirty days.  (Voted Unanimously)                    

              

               Division of Taxation

                        Providence Coal Fire Pizza                162 Granite St  

 

Motion by Ms. Thoman, Seconded by Mr. Gencarella, that the aforesaid establishment be contacted to appear before the Licensing Board at its March 10, 2022, meeting to inform the Board of its intentions regarding operation of the business and to remain closed pending appearance at the board meeting.         (Voted Unanimously)                    

       

               Town Taxes

                        Christina’s                                           82 High St

 

Motion by Mr. Gencarella, Seconded by Ms. Thoman, that the aforesaid establishment be sent a conditional cease and desist pending payment of taxes within thirty days and appearance before licensing board at its March 10, 2022 meeting.  (Voted Unanimously)
