     Mr. Gencarella explained that, at the prior Licensing Board meeting, two neighbors complained that the verbal agreement made between the neighbors and the establishment was violated with regards to the closing of the establishment’s doors during time of entertainment and the time that the entertainment should cease. 

 

     Mr. Van Kruiningen explained that there was a verbal agreement made with the neighbors that the doors to the establishment would be closed at 10:00 p.m. or before 10:00 p.m. if the entertainment started earlier.  He reported that only one email was received from a neighbor complaining that the noise was too loud even with the doors closed and that the general manager responded to the email explaining the verbal agreement.  He stated that there was no verbal agreement that entertainment would cease at 11:00 p.m.  He stated that he spoke with the Chief of Police several days ago and was informed that there were no noise complaints made on the establishment.  He reported that, in the past, the police have been dispatched to the establishment for decibel readings, but there have been no violations. 

 

     Responding to Ms. Thoman-Miller, Assistant Town Solicitor stated that the Licensing Board can consider placing a reasonable stipulation or condition on the entertainment license, such as a requirement that the doors remain closed.  He explained that, if the indoor entertainment is too loud and extends beyond the confines of the establishment, this would be more of a concern of a noise complaint.

1.     Letter to K & D Westerly LLC/dba: Surf Cantina, 15 Canal Street – re: Outside entertainment –

 

     Town Clerk LeBlanc noted that the agenda incorrectly listed the correspondence as “regarding outdoor entertainment” but it should have been listed as “regarding inside entertainment.”  She stated that the letter sent to the establishment correctly addressed inside entertainment.

 

Motion by Ms. Thoman-Miller, Seconded by Mr. Abate, that the correspondence properly referred to the establishment’s inside entertainment license and that the correspondence be placed on file.  (Voted Unanimously)

 

b.    Town Solicitor Report

 

                        None

 

 

10.   ANY OTHER MATTERS TO COME BEFORE THE BOARD

 

a.     Meeting Quorum

 

     Responding to Mr. Gencarella, Assistant Solicitor Diony stated that three members of the Licensing Board are required for a quorum.  He explained that if the Board begins its meeting with a quorum but then one of the three members needs to recuse himself/herself, there is still a quorum.  He stated that, if a vote results in a tie, the motion fails.  He stated that a member could make a motion to continue the matter to a specific date so that it could be considered again.
