Present: Shawn Lacey, Town Manager

Town Manager Lacey stated that entertainment during the day is not an issue; however, entertainment during the night with the garage doors open has caused several neighbors to complain. He stated that the owner and management have agreed to close the garage doors and inside vestibule door at 10:00 p.m. He reported that the decibel levels taken by the Police Department do not exceed the decibel levels of the Town ordinance. He stated that it was suggested that a stipulation be placed on the renewal license that the garage doors and inside vestibule door will be closed at 10:00 p.m. when there is entertainment. He stated that all parties have been very cooperative in the matter.

Participants: Frederick Rathbun, 10 Canal St – quality of life issue due to noise; read aloud from June 9, 2022 Licensing Board Meeting minutes; asked that stipulation be placed on license that all doors, including inside and outside vestibule doors, be closed; neighbors at 12 Canal Street have same concerns; would like music cease at a reasonable hour; Jill Rathbun, 10 Canal St – noise concerns with bass even with doors closed; noise issues with patrons leaving the establishment after hours; suggested the use of sound barriers; Dan Van Kriningen, owner, Surf Cantina – questioned if other establishments have the same stipulations; for the record, one video and one phone call was prior to the hand shake agreement two years ago; trying to operate within the law

Motion by Mr. Abate, Seconded by Ms. Thoman-Miller, that the aforesaid license be granted subject to the prior approval of proper authorities and with the stipulation that all doors, excluding the outside vestibule door, be closed at 10:00 p.m. (

Motion by Mr. Abate, Seconded by Ms. Thoman-Miller, that the motion be amended that the stipulation be in effect during the time of entertainment. (Voted Unanimously)
