Zuchowski, 10 Canal St – re: Believed that the sound level should fall under Residential Receiving Land Use; Chip Greer, 10 Canal St – re: Had a verbal agreement with the business owner but the doors were re-opened during the warmer weather months; asked that all doors be closed during entertainment; Lisa Zuchowski, 10 Canal St; Jill Rathbun, 10 Canal St; asked that all doors and windows be closed at least by 9:00 p.m. when there is entertainment; Dan Van Kruningen, Surf Cantina – re: Concerned that Surf Cantina is being treated different than other Downtown liquor licensed establishments; opposed to closing doors earlier than 10:00 p.m.

 

     Town Manager Lacey stated that an agreement between all parties was reached last year, and a stipulation was placed on the license that all doors, excluding the outside vestibule door, would be closed at 10:00 p.m. when there is entertainment.  He reported that the police have visited the establishment on numerous occasions to test the decibel levels.  He stated that he met with the business owner several weeks ago to discuss the issue and complaints of the Martin House residents and that the business owner is willing to discuss possible options other than the current conditions.  He addressed the noise ordinance and the decibel level limits. 

 

     Town Solicitor Mario addressed the noise ordinance regarding sound levels and determining “receiving land use.”  He explained that when the Licensing Board is considering renewals, it is important that the Board confine its consideration to the past year and review the police reports by reading the narrative to give context as to where the decibel level was taken from and how the number was achieved.  He also felt it important that when reviewing decibel readings to be considerate of the fact of whether it is sustained sound levels.

 

     Chief Gingerella stated that, with regards to the decibel levels, the key is the “sustained” level.  He stated that the decibel level should be taken from inside a neighboring residence, not from the sidewalk.  He stated that the business has not been in violation of the noise ordinance under the current standards. 

 

Motion by Ms. Thoman-Miller, Seconded by Ms. Vorenkamp, that the aforesaid inside entertainment license for K&D Westerly LLC/dba: Surf Cantina be granted with the condition that all doors, including the outside vestibule door, be closed at 10:00 p.m. during entertainment, and subject to the prior approval of proper authorities.  (So Voted 3 to 1 – Mr. Abate dissented)
