Zoning Board – Meeting Minutes

Wednesday, February 3, 2021 - 6:00 p.m.

 

*** Pursuant to Executive Order 20-05 dated March 16, 2020 as extended the Zoning Board meeting was conducted electronically.

 

A.  CALL TO ORDER – Video

Mr. Pawelkiewicz called the meeting to order at 6:00 p.m.

 

B. PLEDGE OF ALLEGIANCE – Video

Mr. Russo lead the meeting attendees in the Pledge of Allegiance.

 

C.  ROLL CALL AND REVIEW OF STAFF ATTENDANCE Video

 

Members Present:     Chairman Walter Pawelkiewicz, Vice Chairman Larry Cioppa, Members Doug Brockway, Jeffrey Russo, and James Torres, and Alternate Member Dawn Robinson

 

Members Absent:      None.

 

Staff Present:             Zoning Official Nathan Reichert, Minute Taker Stephanie LaSota, Assistant Solicitor for Planning & Zoning Todd J. Romano, Esq., and Information Technology Technician Michael Harris

 

D. CHANGES TO AGENDA Video

Consider, discuss and act upon schedule change for Applications

 

Applications under new business were continued to allow for correct public advertising.

 

1. McSweeney, 49 ½ Atlantic Avenue, AP ‘175’ Lot ‘002’ Construct a dune walkover structure (§260-19) Dimensional Variances.

 

Mr. Torres made a motion to continue the McSweeney application to the February 25 6:00 p.m. Zoning Board meeting. Mr. Brockway seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

2. Montesano, 5 Terrace Ave., AP ‘142’ Lot ‘108’ Garage / Front porch addition, Home Occupation greater that 150 sq. ft. (§260-19) Dimensional Variances and Special Use Permit (§260-34). Video

 

Christine Dieter was present on behalf of the Montesano application and said the applicant has no issue with continuing the application to February 25. Mr. Cioppa made a motion to continue the Montesano application to the February 25 6:00 p.m. Zoning Board meeting. Mr. Brockway seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

3. Dixon, 10 Schumann Road, AP ‘146’ Lot ‘05’ Addition of a second floor of an existing structure. (§260-19) Dimensional Variances. Video

 

Mr. Brockway made a motion to continue the Dixon application to the February 25 6:00 p.m. Zoning Board meeting. Mr. Torres seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

4. Ratajack, 57 Crandall Ave., AP ‘164’ Lot ‘269’ Enlarge existing deck (§260-19) Dimensional Video

Variances.

 

Mr. Russo made a motion to continue the Ratajack application to the February 25 6:00 p.m. Zoning Board meeting. Mr. Brockway seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

5. Lamb, 20 Chapman Rd. AP ‘144’ Lot ‘16’ First and second floor addition (§260-19) Dimensional Video

Variances.

 

Mr. Russo made a motion to continue the Lamb application to the February 25 6:00 p.m. Zoning Board meeting. Mr. Brockway seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

6. Sherman, 58 Verdi Ave, AP ‘135’ Lot ‘89’ Expansion of a non-conforming structure, Special Use Video

Permit (§260-34).

 

Mr. Torres made a motion to continue the Sherman application to the February 25 6:00 p.m. Zoning Board meeting. Mr. Cioppa seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

7. South County Cultivators, Inc., 71 Quarry Road, AP ‘55’ Lot “1” Appeal to the Zoning Board of Review. Appeal of Cease-and-Desist Notice of Violation issued November 18th 2020. (§260-38) Right to Appeal. Video

 

Attorney Elizabeth Noonan of Adler, Pollock, & Sheehan P.C., 1 Citizen Avenue, Providence, Rhode Island, was present on behalf of the application and said the applicant agreed to rescheduling the matter to February 25.

Mr. Brockway made a motion to continue the South County Cultivators, Inc. appeal to the February 25 6:00 p.m. Zoning Board meeting. Mr. Russo seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

E. APPROVAL OF MINUTES Video

 

1.    January 14, 2021 – Mr. Torres noted a correction on page 3 of 5 of the minutes that Mr. Cioppa should be listed as Vice Chairman. Mr. Torres made a motion to approve the January 14, 2021 minutes as amended. Mr. Brockway seconded the motion. The motion CARRIED by unanimous vote with no abstentions.

 

F. APPROVAL OF DECISIONS –

Consider, discuss and act on application decisions referred to staff for writing.

 

There was no approval of decisions to discuss.

 

G. PUBLIC HEARINGS Continued Business –

Consider, discuss and act on application(s).

 

1. Zoey Watch Hill, LLC, 14 Larkin Rd., AP ‘185’ Lot ‘30’ Elevate, renovate, add a second floor with rear deck, reconfigure first floor rear deck, add a roof deck and make the home compliant with FEMA flood zone requirements (§260-19) Dimensional Variances. Continued from 12/3/2020, 01/14/21. Continued to March 3rd 2021 for further consideration. Video

1. South County Cultivators, Inc., 71 Quarry Road, AP ‘55’ Lot “1” Appeal to the Zoning Board of Review. Appeal of Cease-and-Desist Notice of Violation issued November 18th 2020. (§260-38) Right to Appeal.

J. STAFF COMMENTS Video

 

1. Congratulations! James Torres has been appointed by Town Council to be a full member of the Zoning Board. Dawn Robinson is now the 1st Alternate. The 2nd alternate position remains open.

 

Mr. Reichert thanked the Board for their understanding and time with the Zoning Board schedule. He officially congratulated Mr. Torres appointment as a full member of the Zoning Board by Town Council and Ms. Robinson’s appointment as the 1st Alternate Member. He encouraged the public to consider applying for the Zoning Board and for members to help recruit a 2nd Alternate Member for the Board.

Mr. Reichert explained that future Zoning agendas are very full and the Board may want to consider scheduling a second March meeting to deliberate applications, however he suggested deciding that at the end of the February 25 meeting and then setting a second meeting date at the first March meeting. There was a consensus of agreement among the Board members to follow Mr. Reichert’s suggestion.

 

K. Applications Declared Complete, Waivers Granted and Scheduled for Public Hearing at the

March 3, 2021 Zoning Board Meeting. Informational no action to be taken.

 

1. Shea, 30 Harbor Drive, AP ‘154’ Lot ‘21’ Raze and re-construct a single-family dwelling (§260-19) Dimensional Variances.

 

2. Longo, 1 Clamshell Drive, AP ‘143’ Lot ‘66’ Construct a (12’ x 27.5’) single car garage (§260-19) Dimensional Variances.

Mr. Russo made a motion to adjourn the Zoning Board meeting at 6:14 p.m. Mr. Brockway seconded the motion. The motion CARRIED by unanimous vote with no abstentions.
