Chapter XIII-A - MUNICIPAL COURT

 

Sec. 1.  Exercised by the municipal court judge.

            The powers and duties for the municipal court judge for the city shall be exercised and performed by a municipal court judge.  (Election of 11-7-95)

 

Sec. 2.  Qualifications of judge.

            The municipal court judge shall be an attorney at law in good standing who has been admitted to the practice of law in this state at least five (5) years prior to this appointment.  (Election of 11-7-95)

 

Sec. 3.  Judge to be elector.

            The municipal court judge shall be a qualified elector of the City of Woonsocket, Rhode Island.  (Election of 11-7-95)

 

Sec. 4.  Appointment of judge.

            The council by resolution shall appoint a municipal court judge to serve for a term of office concurrent with that of the council and until a successor is appointed and qualified.  (Election of 11-7-95)

 

Sec. 5.  Alternate judge.

            The probate court judge shall perform the duties of the municipal court judge in case of sickness, absence form the city, or other disability or ineligibility of said municipal court judge.  The acts of said probate court judge in the performance of said duties shall have the same effect as if performed by said municipal court judge.  In the event the probate court judge and the municipal court judge are the same person, the probate court judge can not serve for whatever reason, or if the city council deems it appropriate the city council may appoint an alternate municipal court judge to act for the regular municipal court judge under the same conditions as the probate judge would have performed the duties of the regular municipal court judge.  (Election of 11-7-95)

 

Sec. 6.  Designation of municipal court clerk.

            The city clerk or the city clerk’s designee shall assume all of the duties of the clerk of the municipal court.  (Election of 11-7-95)

 

Sec. 7.  Duties of the municipal court.

            The clerk of the court shall keep a regular docket of all cases disposed of; shall record the judgements, orders and sentences of said court; and shall furnish said copies thereof when required, for which copies said clerk will charge the same fees as are by law allowed to the clerks of the superior court.  The clerk shall determine and shall also serve as the magistrate and bail commissioner setting bail for the defendant until the court is in session.  (Election of 11-7-95)

 

Sec. 8.  Additional personnel.

            The city council may, by ordinance, authorize the employment of such additional personnel as it deems necessary for the operation of the municipal court.  (Election of 11-7-95)

 

Sec. 9.  Seal: Oaths.

            The municipal court shall have a seal which shall contain such words and devices as the city council shall adopt and approve.  (Election of 11-7-95)

 

Sec. 10.  Session: time, place.

            The municipal court shall have been considered to be in session at all times, at such place or places in the same city as the said court or the judge holding any appointment.

Sec. 11.  Jurisdiction.

            The municipal court shall have original jurisdiction to hear and determine cause involving violations of all ordinances of the City of Woonsocket and violations of Title 45, Chapter 24.3 of Rhode Island General Law entitled “The Rhode Island Housing Maintenance and Occupancy Code,” and other authority granted by the General Assembly.

Sec. 12.  Fines, penalties, imprisonment and costs.

            The municipal court shall impose such fine, penalties, imprisonment and costs as from time to time as may be established by city ordinance.  (Election of 11-7-95)

 

Sec. 13.  Complaints; warrants; writs.

            It shall be lawful for the judge of said court to prescribe and vary the form of all complaints, warrants, writs, or other process, as to make the same constant with the organization, style jurisdiction of said court; and such complaints, warrants writs, and other process shall have the same effect, validity, and extent, and be served, obeyed, enforced, and returned in the same manner and by the same officers, as if issued by the district courts; and they may be served by any constables who are authorized to serve process in civil or criminal cases.  It shall also be lawful for the judge to execute and prescribe such warrants to be served within the City of Woonsocket.  (Election of 11-7-95)

 

Sec. 14.  Compensation of municipal judge.

            The compensation of the judge of municipal court shall be determined by ordinance.  (Election of 11-7-95)
