                 Revocation of Junk Yard License for HT Auto LLC, d/b/a Leo’s Auto, Located at 955 Iron Mine

                 Hill Road       

   B.  DISCUSSION BY COUNCIL, VOTE, OR OTHER ACTION (NO PUBLIC HEARING)

                        NOTICE: The following agenda item is scheduled for Council, Discussion, Vote or Other 

                        Action Only. No public hearing will be held, and No action will be taken at this meeting to

                        adopt, enact, or amend the Zoning Ordinance text or the Zoning Map.

1.      Discussion by the Council, Vote, or Other Action on Ratification and Approval of the Executed Mediation Agreement, including authorization for the Town to pay fifty percent (50%) of the mediation costs for the Honorable Frank X. Flaherty, Retired Rhode Island Supreme Court Justice, to serve as mediator at an hourly rate of $450.00, concerning the following matters:

a. Petition/Application for Amendment to the Zoning Ordinance filed by Pound Hill Realty,

    LLC, c/o 618 Greenville Road, North Smithfield, Rhode Island 02896, owner of certain

    real property located off Old Oxford Road, Pound Hill Road, and Pine Hill Road in the

    Town of North Smithfield, more particularly identified as Town of North Smithfield Tax

    Assessor’s Plat 7, Lot 38, consisting of approximately 89.44 acres (the “Subject

    Property”);

b. Proposed Text Amendment and Zoning Map Amendment to the Town of North Smithfield

    Zoning Ordinance, including creation of a new zoning district entitled Industrial Special

    Management District 1 Overlay, intended to permit mining, quarrying, sand and gravel

    extraction, loam stripping, stone cutting operations, and the crushing, washing, and/or

    processing of materials. The proposed zoning map amendment would change the zoning

    designation of the property located at 14 Pine Hill Road, identified as Assessor’s Plat 7,

    Lot 38 (the “Property”), from Rural Agricultural (RA) and Rural Estate Agricultural

    (REA) to Industrial Special Management District 1 Overlay; and

                       c. Pound Hill Realty, LLC v. Town of North Smithfield, C.A. No. PC-1999-1811.

          C.    Discussion by Council, Vote, or Other Action on Status/Progress Report Items
